Minutes of a regular City Council Meeting held in the Council Chambers of City Hall, Lincoln, IL, on Monday, April 20, 2009.
Mayor Pro Tem Neitzel called the regular City Council Meeting to order at 7:15 p.m. City Clerk Mrs. Gehlbach called the roll. There were ten Aldermen present (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Prather (he left at 7:25 p.m.), Alderman Rohlfs, and Alderman Tibbs) and none absent. Also present were Department Heads Fire Chief Hulett, Police Chief Erlenbush, City Engineer Mr. Mathon, and Safety Building Officer Mr. Last. Also present were City Clerk Mrs. Gehlbach, City Treasurer Mr. Plotner, and City Attorney Mr. Bates.
Mayor Pro Tem Neitzel asked for each guest attending to say their name and why they are here. Those present were Angela Truso with Political Science class of Lincoln College, Ron Keller, Shawn Hughes, Denise Martinek, Shanda (couldn’t hear), Gene Rohlfs here for the cake, David Wilmert, and Cliff Marble.
Those present recited the Pledge of Allegiance to the Flag led by Alderman Prather and Alderman Rohlfs.
Presentation of Plaque and Resolution to Alderman Prather
Mayor Pro Tem Neitzel read the Resolution for Alderman Prather. She asked Alderman Prather to step to the podium. She presented him a plaque.
Alderman Prather said due to work I am not going to be able to stick around. First of all I am humbled to be to have been able to serve it has been an honor and a privilege to work in Ward 4 meeting so many people and I think sometimes you think the big things like a big sewer project or roads is the main thing but sometimes the most rewarding things I've found were the kind of person that has just a little problem that you've just got to call the Street Department for to come and take care of are so happy. That is a rewarding thing and a rewarding feeling. I guess I am the last standing member here of the 1993/1994 Council. I worked with a lot of people and I want to thank everybody all the public servants throughout the years. I haven't worked with one that I didn't respect and really honored and appreciate that they could do what they do. I think those that do serve the community they are a special breed and it takes a special person to do that. I won't be here next week so I want to tell you all thank you. You guys have been very pleasant. I've enjoyed everything we've worked on and I guess that's all I have to say except for one more thing. Alderman Rohlfs is up next and she chaired the Ordinance Committee this year and I was her Vice Chair and there was a suggestion that we tackle an ordinance that really there wasn't much language in it about our city signs. It didn't take long for us to realize why nobody had ever tackled that ordinance. It's been a long time in coming but we I guess I helped some and she has really put a lot of time in it and it's on the agenda but it will be tabled this evening and that is at no fault of the City Attorney.

Presentation of Plaque and Resolution to Alderman Prather
Alderman Prather said it is such a big project and it took us a long time to do it's going to take him a little work to do but I in my heart after all the work couldn't see that being placed on the agenda by Alderman Rohlfs and I so at least it is there and the new administration can vote on it and wanted to give credit for that and make sure everybody knew that it is of no fault of Mr. Bates. Thank you so much everybody.
Presentation of Plaque and Resolution for Alderman Rohlfs
Mayor Pro Tem Neitzel read the Resolution for Alderman Rohlfs. She asked Alderman Rohlfs to come to the podium. She said I want to present this plaque to Alderman Rohlfs I have been sitting next to you and no one could have done the job that you did on the sign ordinance and I want to thank you for that. I'm so proud of you for what you've done on that. She presented her the plaque and said she wished her well.
Alderman Rohlfs said thank you. Have you ever seen a school teacher that didn't want to say something? I guess when you look back at four years and of course in high school you have students from Freshman to the Senior year there are four years there to and it always looks like it's a long time in the beginning but once it's over you realize how fast things do pass. I guess when I appraise the situation I think about all the things that were important and I think the experiences and the people are the most important things that I had to deal with. When I look at the constituents in Ward 4 I would never have gotten to meet a lot of them that I met through emails, telephone calls and personal visits had I not been on City Council. For that I thank them for all of their input and enjoyed working with them. I thank the department heads because you guys have taught me a lot and we worked very well together so I appreciate what you do, the City Attorney, the City Treasurer, City Clerk all the ladies in the office and of course other City Council people. I've gotten some very dear friends I think over the last four years and I hope they are lasting friends. Believe you me I think as Alderman Prather said you have to appreciate these people for all the work they do. I do appreciate and I now understand what you go through and I thank you for all the things that you have helped me to learn throughout the last four years and the guy that's here for the cake. During the last four years needless to say as we know our spouses take telephone calls and tell you need to call these people back and he said you know sometime it's been ten minutes you've got to give them a call back. I appreciate all of the things that he has done in the last four years. Thank you.
Presentation of Plaque and Resolution to Mayor Davis-Kavelman
Mayor Pro Tem Neitzel said Mayor Davis-Kavelman is unable to be here tonight because her husband is in the hospital and she's taking care of him and tonight I am taking care of the City. Alderman Rohlfs read the Resolution for Mayor Davis-Kavelman. Mayor Pro Tem Neitzel said her plaque will be presented at the meeting Tuesday.

Petition for Route 66 Association Illinois Motor Tour on June 13, 2009 by Geoff Ladd, Abraham Lincoln Tourism Bureau of Logan County
Alderman Horn said I move to approve the petition by the Route 66 Association Illinois Motor Tour on June 13, 2009 by Geoff Ladd and along with this we have a statement from Logan County Buildings and Grounds Committee Chairman John Stewart that said it would be ok for the streets to be blocked off on the weekend of June 13 for the Route 66 group coming to Lincoln as the Judges will not be using those spaces that weekend and we have that on file and Alderman Anderson seconded it. Mayor Pro Tem Neitzel asked if there was any discussion. Alderman Rohlfs said Alderman Horn I wanted to know is that just for around the inner just around the court that is the way I understood it. Alderman Horn said I move to approve the petition for L.C.H.S. Grand March on Saturday, May 2, 2009 and I believe they already have sent their insurance. Petition for monthly Cruise-ins by Railsplitter Antique Auto Club by Ray Turner
Alderman Horn said this one has already been approved by us on February 2 but they had sent us the Certificate of Insurance to us and that was confused with if it had been presented and voted upon yet or not so it is already approved. Mr. Bates said were all of those dates approved. Alderman Horn said yes. Alderman Horn said I move to remove it and Alderman Anderson seconded it. Petition for sidewalk at 208 3rd Street and 216 3rd Street by Tim Aper (work to be done by and at the expense of the city)
Alderman Hoinacki said I move to deny this sidewalk petition at 208 3rd and 216 3rd and Alderman Rohlfs seconded it. Mayor Pro Tem Neitzel asked if there was any discussion.
Alderman Hoinacki said this is being denied for the fact that it is a brick sidewalk. I understand that one of the residents, one of the addresses I should say the brick sidewalk is covered fairly well and if it is still good we might just leave it of course as of now we are going to deny this because they are covered.
Mayor Pro Tem Neitzel asked Alderman Armbrust if he had something. Alderman Armbrust said if the walk is to make a fair judgment on it, it should be cleaned I understand that is not easy and I have done it myself but it is totally grass covered and there may be quality brick underneath but I'd like to see it cleaned in some manner so we could make a valid decision on it. Mayor Pro Tem Neitzel said would he be informed of that with a letter or something like that. Mrs. Gehlbach said he would be informed. Mayor Pro Tem Neitzel said anyone else. Alderman Tibbs said whose responsibility is it to clean it. Alderman Armbrust said it is normally the homeowner. Alderman Tibbs said thank you. Mayor Pro Tem Neitzel said is there anything else. Mayor Pro Tem Neitzel asked for the Presentation of Communications:
Alderman Anderson said I just wanted to state that I did have some communications from a resident in my ward this weekend with the races starting up that they were just logging in their annual call to let us know that they do oppose the races being held in Lincoln and that they don't feel they are appropriate within the city and it could discourage individuals from choosing to move here and I just wanted to let everyone know that I had received that communication.

Mayor Pro Tem Neitzel asked for the Presentation of Bids:
Bids for City Hall Roof (tabled 3/16/09)
Alderman Tibbs said I make a motion to remove this from the table and Alderman Hoinacki seconded it. City Clerk Mrs. Gehlbach called the roll call. There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Busby, Alderman Rohlfs, and Alderman Tibbs), zero nays, and one absent (Alderman Prather); motion carried. Alderman Tibbs said I make a motion to award the bid for the City Hall roof replacement with Top Quality Roofing Company base bid in the amount of $152,700 with Alternate Bid in the amount of $3,490.00 and Alternate Bid 3 in the amount of $11,400.00 and to approve the 10% contingency in the amount of $16,759.00 with the authorization to spend contingency funds granted to the Project Architect and the City Engineer jointly and Alderman Henrichsmeyer seconded it. Mayor Pro Tem Neitzel said discussion. Alderman Rohlfs said excited. Alderman Henrichsmeyer said now that we are confident now on how to fund it I am glad to get the roof done and I just wanted to mention that. Alderman Tibbs said it is a well deserved project that the building is a historical building which should stand for many, many years to come and we need to get it replaced. Alderman Armbrust said didn't we have a total dollar did I miss that when you were listing some separate. Alderman Tibbs said yes I mentioned that in the meeting did you not hear that total amount the total amount is $183,209.00. Alderman Armbrust said thank you. Mr. Bates said hang on just a second what was the total $184,349.00. Alderman Tibbs said the total here that I have is $183,209.00 that's because I did not include in the contingency the copper work. Mr. Bates said I think the total of the figures you just read is $184,349.00 which includes in the 10% contingency. Alderman Tibbs said correct. Mr. Mathon said I think what the City Attorney mentioned is correct I believe that Alderman Tibbs you and I had discussed previously I had only figured the contingency on the base bid and alternate 1 amount what was put in the budget was 10% of the entire project and I think that was the difference in what you had calculated. Alderman Tibbs said yes $15,619.00. Alderman Tibbs said I think I have slept with these numbers for I don't know how many weeks it has been quite a project thanks to Alderman Anderson and everyone on Finance, and Mr. Plotner too we had to dig so darn deep to find some figures to get this project done. City Clerk Mrs. Gehlbach called the roll call. Alderman Anderson said I move to approve that we accept the 2008/2009 audit bid by Estes, Bridgewater and Ogden from Springfield for a total amount of the audit bid and the police and fire pension boards at $19,500.00 and Alderman Horn seconded it. Proclamation for Arbor Day 2009
Alderman Rohlfs asked City Clerk Mrs. Gehlbach to read the Proclamation for Arbor Day. City Clerk Mrs. Gehlbach read the Proclamation. Alderman Rohlfs said I move to adopt the Proclamation for Arbor Day 2009 and Alderman Armbrust seconded it. Alderman Rohlfs said I know that there were several Aldermen that were present last Wednesday during the tree planting well actually all we got to do was mulch the trees were already planted Mr. Jackson is not here but I do know that the two trees were planted on the North side of the Courthouse and Alderman Tibbs and Alderman Neitzel were there along with some of the press I think that is starting a new project of new trees around the Courthouse. Procedure Change to discontinue use of Scavenger Stickers
Alderman Anderson said I move to approve the procedural change of issuing stickers and charging for those stickers when we issue the scavenger permits or licenses and Alderman Horn seconded it. Alderman Anderson said we will no longer be issuing the sticker for the windshield and they had to pay extra for that. Mayor Pro Tem Neitzel said do we have to change an ordinance for that. Alderman Anderson said no. City Clerk Mrs. Gehlbach called the roll call. There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Busby, Alderman Rohlfs, and Alderman Tibbs), zero nays, and one absent (Alderman Prather); motion carried.
Intergovernmental Agreement with the County to build and maintain the outdoor warning siren on the property located at 911 Pekin Street
Alderman Busby deferred to Alderman Armbrust. Alderman Armbrust said I move to approve the Intergovernmental Agreement with the Logan County to build and maintain the outdoor warning siren on the property located at 911 Pekin Street and to allow the Mayor Pro Tem to sign that immediately and Alderman Tibbs seconded it. Mayor Pro Tem Neitzel asked for discussion and called on Alderman Hoinacki.

Intergovernmental Agreement with the County to build and maintain the outdoor warning siren on the property located at 911 Pekin Street
Alderman Hoinacki said to clarify you said to place and maintain are they going to maintain this. Alderman Armbrust said yes we are. Alderman Hoinacki said we are or the county is. Alderman Armbrust said we are it is our siren. Alderman Hoinacki said I misunderstood I thought you said the county was. Mr. Bates said the agreement provides that we have to maintain it and the one change that the State's Attorney wanted was if the agreement comes to an end we have to remove it at our expense. Alderman Tibbs said it was removed from City Hall due to the weight and everything and I didn't know if possibly our Fire Chief might want to talk about this removal reason for moving it and getting it up right away because we are without a siren.
Fire Chief Hulett said as I mentioned before the architect recommended this is a new roof and take the old one off and not put a new one on City Hall. We couldn't put it up over on Hamilton Street because of some land issues. The county passed this unanimously in their straw vote last Thursday and I appreciate the county's cooperation so we can get it up and running. If this is approved tomorrow night by the county I suspect by next week this siren will be in service.

Budget Recommendation changes for the Police Department
Alderman Horn said I would like to defer to City Treasurer Mr. Plotner and he would like to explain it.
Mr. Plotner said just a quick note on how we're going to pay for this. $40,000.00 of this will come out of the Capital Projects Fund and this is the last of the G. O. Bond I think at leaves $345.00 down there in the prime fund. It may gather at a penny a month at the rate going down there. $40,000.00 there I talked with Police Chief Erlenbush and Deputy Chief Geriets and they agreed that they could take $10,936.00 from the special police fund that they have a savings account and so we can pay for those two cars that have been ordered since what June, something like that. Since June they have been on order black and whites and they are in high demand now with every police department evidently the State of Illinois and the country is going with black and whites so it is taking a while to get there. I did tell you today when I picked up that bill that they have a due date of May 11 I believe at least they should have something coming on that. That's what they told me out there don't hold me to that hold them.
Mr. Bates said does that need to be paid before April 30.

Budget Recommendation changes for the Police Department
Mr. Plotner said both checks are being cut to be paid before that yeah. It will take six or seven days to get it out of the prime fund and get it here and then we will take it out of the savings account and pay that off.

Alderman Horn said I make a motion to approve the recommendations for the changes in the Police Department as outlined by Mr. Plotner and Alderman Busby seconded it. Mr. Bates said just for the Council's information correct me if I am wrong but the items we're not taking action on tonight that will remain on the agenda and I understand this meeting is going to be adjourned to 7:00 p.m. on Tuesday the 28th. Those items are 7A the sign ordinance, 7F the adoption of a Resolution for the working cash budget 2009/2010, and 12 B repairs to the Singleton Lift Station. The appropriate motion when we get to that point when we adjourn this meeting to 7:00 p.m. on April 28, 2009.
Alderman Busby said Mayor I would like to apologize to the Council and also to Mr. Plotner and Alderman Anderson and City Clerk Mrs. Gehlbach that I was not able to help out on this budget this year. I did a little bit and they both stopped by my house but I just wasn't up to doing any figuring this year so I'm sorry about that.
Mayor Pro Tem Neitzel said we are glad to see you back. Mr. Bates said I think an apology is not needed. Mayor Pro Tem Neitzel said not at all.
Alderman Anderson said I would move to adjourn this meeting to 7:00 p.m. on April 28, 2009 and Alderman Busby seconded it. Mayor Pro Tem Neitzel asked if there was any discussion. City Clerk Mrs. Gehlbach called the roll call. There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Busby, Alderman Rohlfs, and Alderman Tibbs), zero nays, and one absent (Alderman Prather); motion carried.
The City Council Meeting was adjourned at 8:05 p.m.
