Minutes of a regular City Council Meeting held in the Council Chambers of City Hall, Lincoln, IL, on Monday, December 21, 2009.

 

Mayor Snyder called the regular City Council Meeting to order at 7:15 p.m.  City Clerk Mrs. Martinek called the roll.  There were eight Aldermen present (Alderman Armbrust, Alderman Bacon, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert) and two absent (Alderman Anderson and Alderman Turner). Also present were Fire Chief Hulett, City Engineer Mr. Mathon, EMC Manager Mr. Tackett, Safety Building and Zoning Officer Mr. Last, and Police Chief Erlenbush.  Also present were City Treasurer Mr. Plotner, City Clerk Mrs. Martinek, Mayor Snyder, City Attorney Mr. Bates, and Recording Secretary Mrs. Riggs.

 

Those present recited the Pledge of Allegiance to the Flag. led by Alderman Turner.

 

Mayor Snyder said we will move down to the Presentation of Ordinances and Resolutions:

 

Ordinance Levying Taxes for all Corporate purposes for the City of Lincoln, Illinois for the Fiscal Year beginning May 1, 2009 and ending April 30, 2010.

 

The meeting went to the Public Hearing at 7:16 p.m. and returned to the meeting at 7:17 p.m.

 

Alderman Neitzel asked City Clerk Mrs. Martinek to read the Committee’s Report.  Mrs. Martinek read the Committee’s Report.  Alderman Neitzel said I make a motion to accept the Committee’s Report and Alderman Hoinacki seconded.  Mayor Snyder asked if there was any discussion on the Committee’s Report.  City Clerk Mrs. Martinek called the roll call.  There were eight yeas (Alderman Armbrust, Alderman Bacon, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and two absent (Alderman Anderson and Alderman Turner); motion carried.  Alderman Neitzel said I make a motion to waive the second reading and to ok the Ordinance as read at the Committee’s Report and Alderman Hoinacki seconded it. 

 

Mayor Snyder asked if there was discussion on this.  He said as we published in the notice the tax levy represents a 0.893% increase over last year so it is less than 1% increase which amounts to $1,400.00 so it’s not going up much.  He asked if there was any other discussion or comments. 

 

City Clerk Mrs. Martinek called the roll call.  There were eight yeas (Alderman Armbrust, Alderman Bacon, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and two absent (Alderman Anderson and Alderman Turner); motion carried.

Mayor Snyder called for the Consent Agenda:

 

Minutes of the Adjourned City Council Meeting on 12/07/2009

Payment of Bills and Claims:  Finance, Fire, Water and ESDA, Buildings and Grounds, Insurance, Ordinance and Zoning, Police, Sanitation, Sewerage, Street & Alleys, and Sidewalks, Forestry, Lighting

Mayor Snyder asked for the Presentation of Petitions:

There were no Petitions to come before the City Council.

 

Mayor Snyder asked for the Presentation of Communications:

Mayor Snyder read a thank note from Mr. & Mrs. David Wilmert.

 

Mayor Snyder asked for the Presentation of Bids:

There were no Bids to come before the City Council.

 

The Mayor then asked for the Presentation of Ordinances and Resolutions:

 

Ordinance Amending Title 8, Chapter 10 pertaining to Signs of the City Code of the City of Lincoln (tabled 4/28/09)

 

Alderman Neitzel said she would like to leave this on the table.

 

Presentation of Official Reports:

 

City Clerk’s Report for November 2009 is on file.

City Treasurer Mr. Plotner gave an oral report for the month of November 2009. 

 

Presentation of Special Reports:

Written reports from Department Heads were submitted in writing. 

 

Presentation of Unfinished Business:

There was no Unfinished Business to come before the City Council.

Mayor Snyder asked for New Business:

 

Highway Authority Agreement for Illico Property (tabled 2/2/09)

 

Alderman Armbrust asked to leave on the table.

 

Permission to go out to bid for the Palmer Lift Station Bar Screen

 

Alderman Busby said I move for approval to go out to bid for the Palmer Lift Station Bar Screen bids to be back at City Hall on February 16, 2010 by 5:00 p.m. and Alderman Neitzel seconded it.  Mayor Snyder said is there any discussion on this.  Mr. Bates said is this just for material or is this for the job of doing it.  Alderman Busby said this is just the bar screen itself the crew here is going to install it.  Mr. Bates said some of the things we learned in Chicago on any time we get into these bidding things it is extremely important that we keep in mind 1) that we have to reserve the right to reject any bids and 2) they have to comply with any prevailing wage on any public works projects.  Mr. Mathon said there is a provision in the specifications for an onsite inspector, startup guy from the company and it is called I believe in two separate locations that they are required to pay prevailing wage or anyone that works on the project.  Mr. Bates said any language in there that they understand they have to comply with the prevailing wage act of the State of Illinois so there is not any misunderstanding that we’re supervising.  Mr. Mathon said correct.  Mayor Snyder asked if there was any other discussion.  City Clerk Mrs. Martinek called the roll call.  There were eight yeas (Alderman Armbrust, Alderman Bacon, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and two absent (Alderman Anderson and Alderman Turner); motion carried. 

 

Permission to go out to bid for 2 police vehicles

 

Alderman Hoinacki said we need to change that to one vehicle so I would like to go out for bids for a new police car for the bids to be received back to City Hall on February 16, 2010 at 5:00 p.m. and Alderman Tibbs seconded it.  Mayor Snyder said with regard to the change I had asked for the chief to gather a little more information about the other the trade in situation and he has graciously agreed to do that so we will get back on it right after the first of the year when we gather that information but this is just for the car that was totaled to replace that one.  Mayor Snyder asked if there was any discussion.   Mr. Plotner said Mayor just to mention that that’s not putting off the other purchase is it.  Mayor Snyder said we will get permission to go out for that one after the first of the year.  Mr. Plotner said that is in the budget for that new car.  Mayor Snyder asked if there was any more discussion.  City Clerk Mrs. Martinek called the roll call.  There were eight yeas (Alderman Armbrust, Alderman Bacon, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and two absent (Alderman Anderson and Alderman Turner); motion carried.

Designate a Freedom of Information Officer

 

Mayor Snyder said I would need someone to make a motion to appoint our City Clerk as our Freedom of Information Officer.  Alderman Busby said so moved and Alderman Neitzel seconded it.   Mayor Snyder asked if there was any discussion.  City Clerk Mrs. Martinek called the roll call.  There were eight yeas (Alderman Armbrust, Alderman Bacon, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and two absent (Alderman Anderson and Alderman Turner); motion carried. 

 

Announcements

 

Alderman Neitzel said I just want to say the railroad people were out on North Kickapoo Street today you won’t knock out your front axles going over the railroad.  I have been told they have it on the agenda for the spring to have it completely resurfaced.  Hopefully we will have a nice entrance into the city after it is completed but it isn’t too bad now.  They did some repairs on it so it is much better. 

 

Alderman Busby said would you like to inform the Council of what you received. 

 

Mayor Snyder said he received a check from Ameren in the amount of $6,000.00 to go towards our situation involving the electricity change over.  We have that down in the vault and we haven’t deposited that because the letter stated that by accepting it we would be basically saying that we had no further right to any other action against them.  I think we will have another item to bring before you in January and we will talk about both of those.  I think we’ve got those losses there for the electricity covered.  It came too late for us to get it on the agenda for this meeting so we will deal with it at the next meeting. 

 

Mr. Bates said I would like to think it was because you said you would turn it over to your attorney.  Mayor Snyder said I think it was the way that Alderman Busby effectively and forcefully discussed it. 

 

Mayor Snyder said just an announcement that there is no workshop next week on the 29th we have cancelled that because of the holiday so our next meeting will be January 4, 2010 and it is the first Monday of January.  He said Mrs. Martinek would like to have any agenda items to her by the close of business on Wednesday, December 30, 2009.  Anything you would like to have on the agenda if you would get that to our Clerk she would get that on the agenda for the 4th.  He asked if there was any other business to come before the Council. 

 

Mr. Plotner said the $356.00 that is sitting in the Illinois Funds from the G. O. Bond that needs to come out of there and be expended by January 2 so we don’t get involved in arbitrage.  That is according to First Midstate.

Alderman Busby said I would like to wish everybody a very Merry Christmas and moved to adjourn and Alderman Wilmert seconded it.  There were eight yeas (Alderman Armbrust, Alderman Bacon, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and two absent (Alderman Anderson and Alderman Turner); motion carried. 

 

The City Council Meeting was adjourned at 7:53 p.m.
