Minutes of a regular City Council Meeting held in the Council Chambers of City Hall, Lincoln, IL, on Tuesday, September 2, 2008.

Mayor Davis-Kavelman called the regular City Council Meeting to order at 7:15 p.m. City Clerk Ms. Riggs called the roll. There were nine Aldermen present (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs), none absent, and one seat vacant. Department Heads present were Safety and Building Officer Mr. Last, Fire Chief Hulett, EMC Manager Mr. Kitzmiller, Street Superintendent Mr. Jackson, City Engineer Mr. Mathon and Police Chief Erlenbush. Also present were City Clerk Ms. Riggs, City Treasurer Mr. Plotner, City Attorney Mr. Bates, and Mayor Davis-Kavelman.

Those present recited the Pledge of Allegiance to the Flag led by Alderman Hoinacki.

Mayoral Appointment of New Alderman for Ward 1 with Council approval and swearing in of said appointment (tabled 08/18/08)

Mayor Davis-Kavelman said at this time I'd like to appoint our Alderman for Ward 1 to take the place of Alderman Huskins and I need to have it taken off the table. Alderman Prather said I move to take the appointment of the new Alderman for Ward 1 off the table please and Alderman Tibbs seconded it. City Clerk Ms. Riggs called the Roll Call. There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Prather, Alderman Rohlfs and Alderman Tibbs), zero nays, none absent and one seat vacant; motion carried. Mayor Davis-Kavelman said at this time it is my pleasure to present Mr. Dean Henrichsmeyer as our new Ward 1 Alderman and I do need an approval and endorsement by the City Council. Alderman Neitzel said I move to appoint Mr. Dean Henrichsmeyer. Mr. Bates said motion to approve the appointment. Alderman Neitzel said I make a motion to approve the appointment and Alderman Prather seconded it. City Clerk Ms. Riggs called the Roll Call. There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Prather, Alderman Rohlfs and Alderman Tibbs), zero nays, none absent and one seat vacant; motion carried. City Attorney Mr. Bates swore in Mr. Henrichsmeyer. Mayor Davis-Kavelman said Alderman Henrichsmeyer would you go to the podium just real briefly and state if you have family members here have them stand or just say a little bit about yourself. Alderman Henrichsmeyer said this is my wife Christa back here and two small kids as well who are not here to avoid a scene no, but I'm just very happy to be here and I thank you Mayor for the opportunity to serve the citizens of Lincoln with their City Council and I look forward to helping make it the best community it can be. Mayor Davis-Kavelman said thank you take your seat and thank you.

Mayor Davis-Kavelman said at this time I wanted to mention that Alderman Henrichsmeyer will now be the chair of the Sanitation Committee, Vice Chair of the Grounds Committee. Wait, wait we're going to have to work this out a little bit.

Appointment of Ward 1 Alderman

Mayor Davis-Kavelman said I'm going to have change a few things I will have this ready for the next but you are going to be the chairman of the Sanitation Committee I don't know yet where I am going to put you as vice chair but I think you're going to be vice chair of grounds and buildings but I'll have to figure out the other three committees. You'll serve on five committees with chair, vice chair and then serve on three other committees unless I assign some other liaison duties. At this time I'd like to mention that I've moved Alderman Anderson into Finance, Policy and Procedures chair and that should be the only change right now and we'll have the three committees a new roster for you at the next meeting.

Presentation by Fire and Police Chiefs to Mark Miller, Chris Harding, and Robert Sherren

Police Chief Erlenbush said they were doing this together. Mr. Bates said that's what we need is more team work.

Fire Chief Hulett said this was just a, little bit of background for everybody this was an incident that happened on July 8, 2008. I'll read the press release that has been given to the media (see attached). It should pretty well explain it. I would like to present the awards to the three individuals then I would like to mention the other individuals who were involved because this really was a team effort it wasn't just the three that saved this man's life but it was a team effort together and that's how our system should work in Lincoln and Logan County if Chief would like to present the award to Officer Sherren?

Police Chief Erlenbush said this is a life saving award for Corporal Robert Sherren and in it is a nice emblem plus a ribbon he can wear on his uniform nice work Robert.

Fire Chief Erlenbush said I have the same award for Assistant Chief Miller and Inspector Chris Harding. Even though we are here to recognize these three individuals like I said this was truly a team effort. I am glad we have the other individuals involved in that. Just to give you some background Dan Fulscher, Terry Storer who is here tonight and Mr. Fulscher couldn't make it because of another commitment they had the foresight to realize that we had a severe weather event coming into our area in the fairgrounds and they were actually on the scene and had evacuated several hundred people from the circus that night. I guess if they had not done that it would have been more serious injuries besides of the one individual that suffered the cardiac arrest so if Mr. Terry Storer could come up thank you Mr. Storer. When this individual collapsed the dispatch center was activated because Mr. Fulscher had the mobile communication unit at the fairgrounds in the anticipation of an event with the evacuation. We never anticipated a cardiac arrest. During this activation of our EMS system we had a total failure of our communication system because of a lightning strike at the safety complex. Fortunately with the mobile communication unit the dispatcher's coordinate communications were able to let the paramedics know and let firefighters know that they had a cardiac arrest so they could plan for advance life support.

Presentation by Fire and Police Chiefs to Mark Miller, Chris Harding, and Robert Sherren

Fire Chief Hulett said that starts with Mr. Mark Mann he's the county 911 supervisor and if he would like to come up along with Ms. Debbie Kimberlin was the assistant supervisor on duty that night and Ms. Jodi Washam was the dispatcher on duty that night. I appreciate your efforts. This person was resuscitated before the paramedics got there but it doesn't stop there without the intervention of our fine paramedics staff stabilizing this patient was an important factor in getting this patient to the hospital and having him alive today. I would like to recognize two paramedics on duty that day with the Logan County Paramedic Association Robert Kelly and Jeremy Barrow. Our treatment didn't stop there we sent a fire truck out with trained emergency medical technicians on every medical call because in some cases we get there first and we can actually make a difference before the paramedics arrive. We had our on duty staff that night was Inspector Tim Aper and I don't believe he is here tonight and Lieutenant Ken Ebelherr. I'd also like to recognize a police officer Clint Wombles but he arrived after I arrived and I actually witnessed this and this is not second hand information. I saw this and it's not to often that we can make a difference on a cardiac arrest victim but it starts with citizens, CPR calling EMS early and having trained professionals that respond quickly and know what they're doing unfortunately Clint can't make it but the next step in the process that this patient was brought to Abraham Lincoln Hospital where they stabilized the patient and it is my understanding that he was up and talking shortly after he arrived at the hospital. The next day he was transferred to another hospital in Springfield but I'd like to recognize Mr. David Miller who is an RN from the emergency room at Abraham Lincoln Hospital. Finally I think the most important person in this room as far as I'm concerned is the individual that was actually resuscitated and he was kind enough to come out here tonight and if I could have Mr. Craig come up and I would like to introduce you to Mr. Craig and he is a resident of Lincoln and I'm glad to see you thank you Mayor and thank you Aldermen.

Mayor Davis-Kavelman said I wanted to say something real quick. I just wanted to say you know our fire and police officers go out everyday and they don't know what's going to happen when they go out on their call. When they do something that's spectacular like this it's very rewarding and we just very much appreciate it and thank you very much.

Presentation by Alderman Prather and family to Fire and Police Chiefs

Alderman Prather said he would ask that his family come forward. First it is a coincidence that they were being honored the same night we planned on giving this presentation. We would first like to congratulate Mark, Chris and Robert. It is the diligence to dedication like that that makes me proud to be an Alderman in this community. We have recently formed a foundation based on ideas and visions that Shanda has had since the loss of her son. Wyatt Mitchell was three years old when he was called home in a house fire in 2004. Since then she has prayed and dreamed of being able to keep art alive in the youth in our community who otherwise would not have the resources to do so at the same time honoring her late son. Of course many of you know that I lost my father last year due to a flood.

Presentation by Alderman Prather and family to Fire and Police Chiefs

Alderman Prather said I have also been trying to come up with some way into music. He was a well known musician within the area and always loved setting kids on his lap and showing them the guitar showing them a little something about music and trying to keep the music going and that's how I learned. I also wanted to come up with some way to honor him. Together Shanda and our family and I have joined forces and we began using the artistic talents and skills that God has given our family to help others in the name of our loved ones. Our ultimate goal eventually is to provide scholarships in art and music in the name of Wyatt Mitchell and my father and until those funds are realized we will start providing instruments to those children who may otherwise not get the opportunity to be in the school band. We are also seeking out children and have already begun teaching basic art classes to them in our home art studio. This unique art that we will be presenting this evening is something that Shanda has been doing for a while and to date we have not found anyone else who does this kind of work using mosaic tiles to create a stained glass effect. We will soon be offering jewelry; Leah specializes in, pottery and woodwork that my son Ian is real good at. We make every effort to use scrap glass and wood that otherwise would fill our landfills and our local glass businesses and Hundman Lumber have been very generous to our cause in supplying those items. At this time our website is under construction but will soon display a wide variety of items that we can produce on glass. Our preference is to take custom orders so you get exactly what you want but we can create almost anything. Of course we accept donations for our cause we would appreciate anything as far as used music equipment, supplies glass, wood and items such as that so let's get to why we're here. When you consider the tragic losses that our families have faced and the upcoming September 11th anniversary we as a family felt compelled to present this piece of art and recognize those who devote so much dedication and time to our community. Just an example prime example of what you all just seen these people do this every day and too often goes unrecognized for what they do so we wanted to our first hand experiences has allowed us to see what they do and how they do their work so at this time we want to let them know that we appreciate them and sincerely thank them for everything they do in our community and we will never forget those who lost their lives on September 11th for doing the exact same thing as what you just heard about. We'd ask both chiefs to come up and we're going to make one for each office a different type as this one and we'd like to display it at City Hall. We're going to have the award shop make a plaque for it.

Alderman Hoinacki said I move to approve the Sidewalk Petition at 508 N. Kickapoo Street with the final dimensions to be at the discretion of the Street Superintendent by Chris Whiteman and Alderman Rohlfs seconded it. Mayor Davis-Kavelman asked if there was any discussion. Mayor Davis-Kavelman said I do have a question I live right next door and I didn't know the petition was here for 27 1/2 years I've not gotten my sidewalk done because I've been involved with City Council I didn't know if there was any way can I add on to that. Mr. Jackson said there are two other homeowners just down at the end of the block that we have to do. Mr. Jackson said we're going to do that whole block, hit and miss. Mayor Davis-Kavelman said I want to be upfront with everybody for 27 years. Alderman Hoinacki said fill out a petition. Mayor Davis-Kavelman asked if there was any discussion. Alderman Armbrust said we do not repair private driveways even though that portion is located across city property it was possibly put in before zoning requested that they come to the Council or it was put in with Council permission 40 years ago that is not our position or job or practice to repair that. Petition for street closures on October 16, 2008, for the re-enactment at the Logan County Courthouse by the Abraham Lincoln Bicentennial Commission

Alderman Horn said I move to approve the Petition for street closures on October 16, 2008, for the Abraham Bicentennial Commission and their insurance is covered by the City and Alderman Prather seconded it. Mayor Davis-Kavelman asked if there was any discussion you know Mr. Conzo is present here today does anyone have questions for him on behalf of the Abraham Lincoln Bicentennial Commission. Mayor Davis-Kavelman said I just hope everyone can get involved with this it is very, very important. City Clerk Ms. Riggs called the Roll Call. Mayor Davis-Kavelman said I did want to mention one thing real quick and I didn't want to rain on Alderman Rohlfs parade because she has worked very hard for this. This was one of the main speeches that or the last speech President Lincoln said before here in Lincoln, Illinois before he took off to become President. It is very important.

Mayor Davis-Kavelman asked for the Presentation of Communications:

Mayor Davis-Kavelman said there was a letter from Betty Gehlbach. She has served one term and two terms for me so she has served 12 years as our Planning Commission chair and she has submitted a letter of resignation and we will be honoring her with a Proclamation two weeks from now. I don't have the letter with me now I thought I did but I don't. I do want to ask for that approval and I will be replacing with the Vice Chair who is Dave Klug I will ask for that on next voting meeting which is on the 15th as I will be asking for an appointment to the Lincoln Planning Commission which is under Item D which I am tabling right now under new business.

Mayor Davis-Kavelman asked for the Presentation of Bids:

Bids for Backhoe Loader

Alderman Armbrust said last meeting committee meeting we opened bids for a backhoe loader. We had six companies bid and it was noted in the Courier that the low bid was $75,871.00 and I want to point this out that that was for a device machine that would not meet our needs so we have overlooked that one. I would like to move to accept the bid from Marten Incorporated in Springfield, Illinois for the John Deere and I don't have the tractor number on that I am sorry like a 410JTT I believe but anyway the bid was $78,000.00 and that is the second lowest bid that we received.

Alderman Tibbs said I second the motion. Mayor Davis-Kavelman asked if there was any discussion. Alderman Neitzel said I just want to ask one question what does it mean no thumb for the back of the hoe.

Bids for Backhoe Loader

Mr. Jackson said the back the way it is there is a hydraulic thumb picking up concrete and debris and stuff. The Volvo doesn't come equipped with one of those they don't manufacture one.

Alderman Neitzel said ok just in case somebody asks.

Mr. Bates asked if the low bid failed to meet the specs. Mr. Jackson said correct and then the next bid. Mr. Bates said is this the lowest bid that meets the specifications. Mr. Jackson said yes. Mayor Davis-Kavelman said any further discussion regarding the backhoe. City Clerk Ms. Riggs called the Roll Call. Mayor Davis-Kavelman asked for the Presentation of Communications:

Alderman Busby said Chief Hulett has approached me with regard to sending some firemen to New Orleans area and I will let him elaborate on it.

Fire Chief Hulett said this is something we did with Hurricane Katrina with our state wide mutual aid system three years ago. To give you the sequence of events Friday night we were put on standby state wide basically just to be prepared in case something happens. Fortunately it wasn't a major event that hit New Orleans but there's a lot of damage I'm told up to $10B worth of damage. Monday afternoon we were notified can we send a fire truck and four firefighters to Louisiana to help out for about one week. Last night we met with all the county, Logan County fire chiefs our mutual aid group made a decision that we can send one fire truck a pumper from Lincoln Rural with two firefighters from the City of Lincoln. I was told about a half hour ago Macon County was mobilized to send a fire truck down there. I was told that just a few minutes ago we got a fax then if I know before the meeting is over I will tell you. What this means that tomorrow morning they may be leaving Lincoln for a up to seven day deployment in the New Orleans general area. You may ask why is Illinois going down to New Orleans we had one of the premiere most organized disaster response teams in the country and the last time we came down there we were organized they realized the next time something happened they call Illinois. Something God forbid something happens in Illinois we can get all kinds of help from all our neighbors in the Midwest and Louisiana will come up here to help us. As far as the financial issues the Federal Government through Federal Declaration will pay our personnel will also cover any wages that we have to hire personnel back to cover our city and also for the use of one pickup that we are going to send along with Lincoln Rural's pumper. The chiefs have all agreed that since that Lincoln Rural was down to one pumper we're down one pumper because of maintenance issues that all the surrounding areas are going to pick it up and help us out. In my opinion we're not losing any level of fire protection because we have a good mutual aid system in place.

Mutual Aid to Louisiana

Fire Chief Hulett said like I said if I know before the end of the meeting I will certainly let you know or certainly notify the mayor as soon as we're mobilized. Alderman Busby said thank you Chief Hulett. Mayor Davis-Kavelman said as I understand they will reimburse us for all of the expenses that we incur during all of this time.

Fire Chief Hulett said yes we would initially have to give them my city credit card just so they have some money to buy some food and water on a day down. We're told to bring food and water for five days because it may be that long before we can get stationed and mobilized down there and get food and water. Everything that we spend we'll get reimbursed from the Federal Government.

Mayor Davis-Kavelman said do they immunize our officers when they go down there or are they prepared to go.

Fire Chief Hulett said they go through the process where they credential them because they don't want people that don't belong in the area. They will give them the proper shots down there and before they leave they will actually do some debriefing before they release them to come back to Lincoln.

Mayor Davis-Kavelman said thank you very much. Mr. Bates said you probably need to vote on that. Mayor Davis-Kavelman said yes. Mr. Bates said it is not on the agenda but I'll fight that battle if somebody raises it. Mayor Davis-Kavelman said who would like to make that motion. Mr. Bates said it is a matter that needs to be voted on as far as I'm concerned. Alderman Busby said I move that the Chief be given the authority to send 2 firemen to the stricken area in Louisiana I believe is where they are going, am I right Ken. Fire Chief Hulett said yes. Alderman Neitzel said probably Houma. Alderman Busby said they will probably work with FEMA and it will be reimbursed by Federal Government. Mr. Bates said, and pickup and use of our equipment. Alderman Busby said oh that's right plus pickup is going along with the city pickup truck. Alderman Busby said one week. Alderman Prather seconded the motion. Mayor Davis-Kavelman said I need to add one more item to communications too. I was called late last week regarding a situation we have with Amtrak and the Lincoln Depot facilities. I will be calling a meeting no I have one scheduled for the 12th and two of you may be involved with that. I haven't gotten that far yet. We're trying to find some way to help Amtrak the Depot and the city the whole thing I did want to apprise you that we are working on that situation.

Proclamation for Vince Long

Mayor Davis-Kavelman said Mr. Long told me he would not be present tonight so we will do that the 15th as well. This is our Veterans Commissioner and he was moved elected to be the whole State of Illinois with our VFW.

Alderman Busby said I move to table it and Alderman Prather seconded it. City Clerk Ms. Riggs called the Roll Call. Alderman Neitzel said I wish to take it off the table and Alderman Busby seconded it. City Clerk Ms. Riggs called the Roll Call. There were ten yeas (Alderman Anderson, Alderman Armbrust Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs), zero nays, and none absent; motion carried. Jetting Sewers at government facilities

Alderman Neitzel said yes. Alderman Anderson seconded it.

Mayor Davis-Kavelman asked if there was any discussion on this issue. The only thing I'd like to say is the motion is to deny I know we get into liabilities and it's expensive in case something would happen with our community it's nice to have reciprocity agreement sometimes with our various facilities. She called on Sewerage Treatment Plant Manager Mr. Kitzmiller.

Mr. Kitzmiller said Mayor we were speaking with both prisons in doing this and we were working out an agreement. Mayor Davis-Kavelman said right. Mr. Kitzmiller said I was contacted late Friday afternoon and they had decided at this time it's not best to move forward with an agreement so it was actually their decision to not move forward. Mayor Davis-Kavelman said very good. Alderman Prather said could you just have the attorney clarify what a deny vote is on this. Mr. Bates said well I believe my understanding is we've been requested to jet the sewers at the two prisons. Alderman Neitzel said right.

Mr. Bates said that is what has been considered and it was tabled while it was considered and I suggested we could get an intergovernmental agreement and that's what Mr. Kitzmiller has been working on. They have decided not to do that under the terms I think we suggested they would be best so as I understand the motion to deny we will not be jetting the sewers at the private sewers at the prison.

Alderman Prather said ok thank you just so everybody is clear what you're voting on. City Clerk Ms. Riggs called the Roll Call. Approval of Per Diem Amount ($300.00) for Municipal League Conference Attendees

Alderman Anderson said I would move to approve the per diem amount of $300.00 for the Municipal League Conference and Alderman Neitzel seconded it. Mayor Davis-Kavelman asked if there was any discussion on this issue. Mayor Davis-Kavelman said Alderman Henrichsmeyer we will discuss that with you later. City Clerk Ms. Riggs called the Roll Call. There were ten yeas (Alderman Anderson, Alderman Armbrust Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs), zero nays, and none absent; motion carried. Mr. Bates said might I add a precautionary word on that with any per diem when you submit your expense vouchers you need to detail the expenditures that you use that per diem for and if you have not exhausted it for city business you must refund.

Alderman Busby said I move for Approval to go out for bids for Partial Replacement of Emergency Siren at City Hall bids to be returned by October 14th and Alderman Prather seconded it. Mayor Davis-Kavelman said is there any discussion. City Clerk Ms. Riggs called the Roll Call. There were ten yeas (Alderman Anderson, Alderman Armbrust Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs), zero nays, and none absent; motion carried.

Mayoral appointment to the Lincoln Planning Commission

Mayor Davis-Kavelman said I had someone in mind but we have another conflict. Alderman Prather said I make a motion to table this topic and Alderman Anderson seconded it. City Clerk Ms. Riggs called the Roll Call. There were ten yeas (Alderman Anderson, Alderman Armbrust Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs), zero nays, and none absent; motion carried.

Fire Chief Hulett said I was just told that they are leaving tomorrow morning at 6:00 from Effingham with a five to seven day deployment. Mayor Davis-Kavelman said who are the firefighters going. Fire Chief Hulett said Assistant Chief Martin and Firefighter Coffey and then two firefighters from Lincoln Rural. Mayor Davis-Kavelman said ok thank you very much.

Alderman Busby made a motion to adjourn and Alderman Busby seconded it. There were seven yeas (Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs), zero nays, two absent (Alderman Anderson and Alderman Armbrust); motion carried.

The City Council Meeting was adjourned at 8:05 p.m.
