Minutes of a regular City Council Meeting held in the Council Chambers of City Hall, Lincoln, IL, on Monday, March 2, 2009.

 

Mayor Davis-Kavelman called the regular City Council Meeting to order at 7:15 p.m.  Acting City Clerk Mrs. Gehlbach called the roll.  There were eight Aldermen present (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, and Alderman Tibbs) and two absent (Alderman Rohlfs and Alderman Prather).   Also present were Department Heads Fire Chief Hulett, Police Chief Erlenbush, EMC Manger Mr. Kitzmiller, City Engineer Mr. Mathon, Safety Building Officer Mr. Last, and Street and Alley Superintendent Mr. Jackson.  Also present were Acting City Clerk Mrs. Gehlbach, Mayor Davis-Kavelman, and City Attorney Mr. Bates. 

 

Those present recited the Pledge of Allegiance to the Flag led by Alderman Neitzel. 

 

Mayor Davis-Kavelman called for the Presentation of the Minutes:

Alderman Anderson said I would move to approve the Regular Council meeting minutes of 02/17/09 as presented and Alderman Neitzel seconded it. There were eight yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, and Alderman Tibbs), zero nays, and two absent (Alderman Rohlfs and Alderman Prather); motion carried.

 

Mayor Davis-Kavelman asked for the new Eagle Scouts to come forward and stand at the podium and that they were with Troop 102.  She asked them to turn around for the camera and state their name clearly.  They were Trevor Airington, Matthew Mason, Corey Janson, William Grover, and Jamie Wyatt.  She said just this last week they have received this prestigious award and I think it’s very special when you have that many young men that take the time and effort to do something like this especially doing community projects to get that far in their scouting.  I would like to give them a hand and also a letter from the City Council will be coming to all seven of them.  Thank you very much.  She asked for each of them to say real quickly into the microphone your name again and what project you did for your Scout project. 

 

Trevor Airington raised funds for and built bleachers for the baseball field out at Zion Lutheran School.  Matthew Mason built picnic tables and benches for Maple Ridge Care Center.  Corey Janson raised funds for new desks at Carroll School.  William Grover raised funds and helped Habitat for Humanity House.  Jamey Wyatt raised funds and built the sign at Adams School. 

 

Mayor Davis-Kavelman said there were two other Eagle Scouts which were Warren Grover and Ori Ingram.  Thank you very much.

Mayor Davis-Kavelman asked for the Presentation of Petitions:

 

Petition for Sidewalk at 511 Omaha Avenue by Patricia Pispas (work to be done by and at the expense of the city)

 

Alderman Hoinacki said I move to approve the sidewalk petition at 511 Omaha Avenue with the final dimensions being at the discretion of the Street Superintendent for Patricia Pispas and Alderman Neitzel seconded.  Mayor Davis-Kavelman said is there any discussion it’s at the city’s expense.  Alderman Hoinacki said I’m sorry that’s correct the work to be done is at the city’s expense.  Mayor Davis-Kavelman said Street Superintendent Mr. Jackson you looked it over too.  Mr. Jackson said it’s a small walk but it does need some work done to it. Mayor Davis-Kavelman said any more discussion on this issue.  Acting City Clerk Mrs. Gehlbach called the roll call.  There were eight yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, and Alderman Tibbs), zero nays, and two absent (Alderman Rohlfs and Alderman Prather); motion carried.

 

Petition to trim tree at 1104 Pulaski Street by Thomas Elliott

 

Alderman Hoinacki said I move to approve the petition to have the tree trimmed at 1104 Pulaski Street and that was requested by Thomas Elliott and Alderman Anderson seconded it.  Acting City Clerk Mrs. Gehlbach called the roll call.  There were seven yeas (Alderman Anderson, Alderman Armbrust, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, and Alderman Tibbs), one abstention (Alderman Busby), zero nays, and two absent (Alderman Rohlfs and Alderman Prather); motion carried.  Mayor Davis-Kavelman called on Alderman Busby.  Alderman Busby said Mayor Davis-Kavelman I abstained because that happens to be my grandson.

 

Petition from Lincoln/Logan County Chamber of Commerce for use of city property and streets during the 2009 Lincoln Art and Balloon Festival by Andy Hake

 

Alderman Horn said I move to approve the petition by the Chamber of Commerce for use of city property and streets during the 2009 Lincoln Art and Balloon Festival with proof of insurance for August 29 and 30, 2009 and Alderman Anderson seconded it.  Mayor Davis-Kavelman said it’s always nice to have the Balloon Fest they do lots of really good things for our community and bring in dollars and bring in tourists.  Acting City Clerk Mrs. Gehlbach called the roll call.  There were eight yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, and Alderman Tibbs), zero nays, and two absent (Alderman Rohlfs and Alderman Prather); motion carried.

Mayor Davis-Kavelman asked for New Business:

 

Mayoral appointment of Susan Gehlbach, as City Clerk, for the remainder of current term

 

Alderman Anderson said I move to approve that Susan Gehlbach be appointed as City Clerk for the remainder of the current term and Alderman Neitzel seconded it.  Acting City Clerk Mrs. Gehlbach called the roll call.  There were eight yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, and Alderman Tibbs), zero nays, and two absent (Alderman Rohlfs and Alderman Prather); motion carried.

 

City Attorney Mr. Bates swore in Mrs. Gehlbach. 

 

Mrs. Gehlbach said I just have a quick thank you.  I want to thank City Attorney Bill Bates, Mayor Davis-Kavelman, Recording Secretary Mrs. Risa Riggs, all the department heads, City Council members, my family and plus everybody downstairs the girls in my office (Doris Anderson and Brenda McCabe) thank you all for your support and your help.  Thank you. 

 

Back pay for Susan Gehlbach retroactive to February 10, 2009 at the City Clerk’s starting salary

 

Alderman Anderson said I move to approve the back pay for Susan Gehlbach retroactive to February 10, 2009 at the City Clerk’s starting salary of $157.70 per day and Alderman Busby seconded it.  City Attorney Mr. Bates said I just want to make sure that it’s covered going forward to the end of the term per the stated amount in the Ordinance.  Alderman Anderson said yes, that’s the intention.  Mayor Davis-Kavelman said to the end of this term.  Alderman Busby said that’s what the break down is Mr. Bates.  Mr. Bates said I figured somebody ran it but I just wanted to make sure that it’s not just the back pay going forward to the end of the term.  Alderman Anderson said to the end of the current term correct.  Mayor Davis-Kavelman said is there any discussion and she wanted to say thank you very much Council for doing this and I feel this is the appropriate method to do it.  City Clerk Mrs. Gehlbach called the roll call.  There were eight yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, and Alderman Tibbs), zero nays, and two absent (Alderman Rohlfs and Alderman Prather); motion carried.  City Clerk Mrs. Gehlbach said thank you everybody. 

 

Mayor Davis-Kavelman asked for the Presentation of Communications:

1984 Used Fire Pumper Bids

 

Alderman Busby said I move for approval to sell the 1984 Fire Truck to the high bidder for $4,500.00 as is and Alderman Armbrust seconded it. City Clerk Mrs. Gehlbach called the roll call.  There were eight yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, and Alderman Tibbs), zero nays, and two absent (Alderman Rohlfs and Alderman Prather); motion carried.   

 

The Mayor asked for the Presentation of Ordinances and Resolutions:

 

Ordinance Rezoning Real Estate to C-2 Commercial by Lincoln IL RX (530-534 Woodlawn Rd)

 

Alderman Armbrust asked City Clerk Mrs. Gehlbach to read the Committee’s Report.  City Clerk Mrs. Gehlbach read the Committee’s Report.  Alderman Armbrust said I move to adopt the Committee’s Report and Alderman Neitzel seconded it.  There were eight yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, and Alderman Tibbs), zero nays, and two absent (Alderman Rohlfs and Alderman Prather); motion carried.   Alderman Armbrust said I move to waive the second reading and approve the ordinance as read and Alderman Neitzel seconded it.  Mayor Davis-Kavelman said now we ask for questions and we do have a gentleman in our audience on behalf of the petitioner here tonight and she called on Alderman Neitzel.  Alderman Neitzel said I just want to say over the air that the original ordinance was read in the committee meeting.  Mr. Tom Lowe was present and said he made himself available for questions.  Mayor Davis-Kavelman said we welcome you to our community.  City Clerk Mrs. Gehlbach called the roll call.  There were eight yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, and Alderman Tibbs), zero nays, and two absent (Alderman Rohlfs and Alderman Prather); motion carried.

Ordinance Amending Subparagraph (A) of Section 2 of Chapter 1 of Title 6 of the City Code entitled “Police Sergeants, Police Detectives, and Police Corporals”

 

Alderman Armbrust said I move to waive the second reading and approve the ordinance as read and Alderman Neitzel seconded it.  Mayor Davis-Kavelman said is there any discussion regarding this issue.  Mayor Davis-Kavelman asked if the Police Chief wanted to say anything about this.  Police Chief Erlenbush said I think I covered it at the last meeting Mayor Davis-Kavelman.  City Clerk Mrs. Gehlbach called the roll call.  There were eight yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, and Alderman Tibbs), zero nays, and two absent (Alderman Rohlfs and Alderman Prather); motion carried.   

 

The Mayor then asked for the Presentation of Claims, Presentations, Reading, Reference and Reports Thereon:

 

Alderman Anderson made a motion by Roll Call to approve as presented: Finance, Policy & Procedure, Sanitation, Insurance, and Grounds, Buildings & Local Improvements Committees' Reports by roll call and Alderman Neitzel seconded it. Mayor Davis-Kavelman asked if there was any discussion on the bills.  City Clerk Mrs. Gehlbach called the roll call.  There were eight yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, and Alderman Tibbs), zero nays, and two absent (Alderman Rohlfs and Alderman Prather); motion carried.   

 

Mayor Davis-Kavelman then asked for the Presentation of Official Reports:

City Clerk Mrs. Gehlbach said there were no Official Reports to come before the City Council.

Approve contractual work with WTI software consultant not to exceed 80 hours

 

Alderman Anderson said I move that we approve the contractual work with WTI software consultant not to exceed 80 hours and Alderman Neitzel seconded it.  Mayor Davis-Kavelman said is there a cost involved there.  Alderman Anderson said it is hourly.  Mayor Davis-Kavelman said is there any discussion.  Alderman Neitzel said well do we have to give a dollar figure out there.  Mayor Davis-Kavelman said it’s less than the $10,000.00 do we need to put it in there I mean do you want to put it in there.  Alderman Anderson said it is a contractual amount it’s $150.00 an hour.  Mayor Davis-Kavelman said we agreed it was very much needed.  City Clerk Mrs. Gehlbach called the roll call.  There were eight yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, and Alderman Tibbs), zero nays, and two absent (Alderman Rohlfs and Alderman Prather); motion carried.   

 

Request an honorary street sign for Habitat’s Dahm corner at the intersection of Peoria and Hamilton Street

 

Alderman Armbrust said I move to accept the request for the honorary street sign for Habitat’s Dahm corner and Alderman Tibbs seconded it.  Mayor Davis-Kavelman said is there any discussion.  Alderman Busby said do we have a location on that.  Alderman Armbrust said at the intersection of Peoria and Hamilton Street Habitat has built three houses in that area in the last few years and they wanted to honor Mr. George Dahm who has been quite involved.  Mr. Last said isn’t that Lincoln Avenue instead of Peoria.  Mayor Davis-Kavelman said it should be Lincoln Avenue because Peoria is my street.  Mr. Last said those three houses were built on the corner of Lincoln Avenue and Hamilton.  Mr. Jackson said it would be Lincoln Avenue. Alderman Tibbs said she would withdraw her second.  Alderman Armbrust said he would remove his motion.  Alderman Armbrust said I move to accept the request for the honorary street sign for Habitat’s Dahm corner at the intersection of Lincoln Avenue and Hamilton Street and Alderman Tibbs seconded it.  Alderman Tibbs said it’s no wonder we get all tangled up about this because Mr. Dahm has been so active with this Habitat I know that all of us have been to one of the groundbreaking ceremonies at one time or another I just think this is a wonderful thing to put this up in his honor.  City Clerk Mrs. Gehlbach called the roll call.  There were eight yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, and Alderman Tibbs), zero nays, and two absent (Alderman Rohlfs and Alderman Prather); motion carried.   

 

Mayor Davis-Kavelman asked everyone in the audience to stand and state their name.  The audience was Nathan Turner, David Wilmert, Tom Lowe, Jim Gehlbach, Tyler Gehlbach, Chris Graue, Rick Janson, Cliff Marble, Keith Snyder, and Bill White.  Mayor Davis-Kavelman said we also have our press and thanked everyone.

Alderman Neitzel said she needed to call a meeting next Tuesday.  She said they had received memorandums this evening and there will be a meeting at 6:15 p.m. on March 10, 2009 to discuss those items.

 

Alderman Tibbs said on Friday afternoon I received a call from Congressman Aaron Schock which it was a shock.  He called to tell me that the grant that we put in for that it has been at least a year now for security for City Hall and it went through so we are glad to hear about that.  At this time I would like to thank Mr. Dan Fulscher and Terry Storer these gentlemen were very helpful. 

 

Alderman Horn said I’ve had several people ask me why our schedule for meetings, are not up on our website.  Is there a reason that that is not done?

 

Mayor Davis-Kavelman said we will make a note to get that on there to get the schedule on the website. 

 

Mayor Davis-Kavelman said I do want to tell you that I forgot to mention this a while back when we got telephoned from CNN to do that little thing that Mr. Gleason did, Mrs. Bartlemay and State Bank for CNN during Abraham Lincoln’s Birthday he commented and this was just not ironic but he commented what a wonderful website Lincoln, Illinois had so I just had to share that with everyone.  He said he had seen quite a few and was very impressed with that. 

 

Alderman Neitzel made a motion to adjourn and Alderman Anderson seconded it.  There were eight yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, and Alderman Tibbs), zero nays, and two absent (Alderman Rohlfs and Alderman Prather); motion carried.   

 

The City Council Meeting was adjourned at 7:42 p.m.
