Minutes of a regular City Council Meeting held in the Council Chambers of City Hall, Lincoln, IL, on Monday, May 18, 2009.

 

Mayor Snyder called the regular City Council Meeting to order at 7:20 p.m.  City Clerk Mrs. Martinek called the roll.  There were nine Aldermen present (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert) and one absent (Alderman Turner).   Also present were Department Heads Fire Chief Hulett, Police Chief Erlenbush, Street Superintendent Mr. Jackson, EMC Manager Mr. Tackett, and Safety Building Officer Mr. Last.  Also present were Mayor Snyder, City Clerk Mrs. Martinek, City Treasurer Mr. Plotner, and City Attorney Mr. Bates. 

 

Those present recited the Pledge of Allegiance to the Flag led by Alderman Anderson.

 

Mayor Snyder said if we could have a moment of silence for, in memory of Bob Graue certainly a successful businessman in this community and a very generous community leader as well as a great dad and grandpa and husband.

 

Mayor Snyder called for the Presentation of the Minutes:

Alderman Anderson said I would move to approve the Regular Council meeting minutes of 05/04/09 as presented and Alderman Horn seconded it. City Clerk Mrs. Martinek called the roll call.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and one absent (Alderman Turner); motion carried.

 

Mayor Snyder asked for the Presentation of Petitions:

 

Petition for sidewalk at 521 Maple Street by Thomas Eimer (work to be done by and at the expense of the city)

 

Alderman Armbrust said I move to accept the petition for the sidewalk at 521 Maple Street work to be done by and at the expense of the city and Alderman Neitzel seconded it.  Mayor Snyder asked if there was any discussion about that.  City Clerk Mrs. Martinek called the roll call.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and one absent (Alderman Turner); motion carried.

Petition for curb cut at 702 N. Madison by Chrystal Olbris

 

Alderman Armbrust said I put it on there but in reality I should have let Alderman Henrichsmeyer.  Alderman Armbrust said I move to accept the petition for curb cut at 702 N. Madison by Chrystal Olbris and any information she needs, can be obtained with the Street Superintendent and Alderman Wilmert seconded it.  Mayor Snyder asked if there were any questions comments.  City Clerk Mrs. Martinek called the roll call.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and one absent (Alderman Turner); motion carried.

 

Petition for permit to install driveway on public right-of-way at 201 N. Elm Street by Tom Lockenour

 

Alderman Armbrust said I move to accept the petition for permit to install driveway on public right-of-way at 201 N. Elm Street by Tom Lockenour and Alderman Wilmert seconded it.  Mayor Snyder asked if there was any discussion.  Alderman Armbrust said Mr. Jackson do you want to comment on this there is no curb cut involved.  Mr. Jackson said it is currently a 10 foot approach to a 24 foot driveway he is extending it to match the driveway.  Alderman Armbrust said do we have to put a culvert in.  Mr. Jackson said no it is a curb and gutter street.  Alderman Armbrust said thank you.  City Clerk Mrs. Martinek called the roll call.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and one absent (Alderman Turner); motion carried.

 

Mayor Snyder asked for the Presentation of Communications:

City Clerk Mrs. Martinek read the Letter from Tom Martin, Lincoln Fire Department Assist Chief for his retirement on May 31, 2009.

 

Mayor Snyder asked for the Presentation of Bids:

Mayor Snyder said there were no Bids to come before the City Council. 

 

Mayor Snyder asked for the Presentation of Ordinances and Resolutions:

 

Ordinance Amending Title 8, Chapter 10 pertaining to signs of the City Code of the City of Lincoln

 

Alderman Neitzel asked to leave that on the table.

Ordinance authorizing the borrowing of funds pursuant to 65 ILCS 5/8-1-3.1

 

Alderman Neitzel asked if there was a committee report.  Mr. Bates said the Committee Report was probably overlooked with everyone being new to this process the committee report would be essentially that your committee to whom an Ordinance having been referred to the title of Ordinance authorizing the borrowing of funds pursuant to 65 ILCS 5/8-1-3.1 has been approved by the committee and recommended its approval.  Alderman Neitzel said I make a motion to accept the Committee's Report and Alderman Hoinacki seconded it.  Mayor Snyder said is there any discussion on that and he called on Alderman Hoinacki.  Alderman Hoinacki said yes for the record Mr. Bates did read this Ordinance at our committee meeting so it was read to us.  Mayor Snyder said this is the borrowing of funds for the roof work.  Alderman Neitzel said right.  Mayor Snyder asked if there was any further discussion.  Alderman Armbrust said that was in the amount of $156,000.00.  Mayor Snyder said correct.  Mr. Bates said the only thing you're voting on at this moment is the committee report.  City Clerk Mrs. Martinek called the roll call.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and one absent (Alderman Turner); motion carried.  Alderman Neitzel said I move to waive the 2nd reading and accept the Ordinance as read and Alderman Hoinacki seconded it.  Mayor Snyder asked if there was any discussion on the Ordinance.  Alderman Neitzel said it is for the $156,000.00.  City Clerk Mrs. Martinek called the roll call.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and one absent (Alderman Turner); motion carried.

 

Resolution relating to participation by elected officials in IMRF

 

Alderman Neitzel asked City Clerk Mrs. Martinek to read the Resolution.  City Clerk Mrs. Martinek read the Resolution.  Alderman Neitzel said I make to motion to accept the Resolution relating to participating by elected officials in IMRF as read and Alderman Hoinacki seconded it.  Mayor Snyder asked if there was any discussion about the IMRF Resolution.  Mr. Bates said do we already have a Resolution having everybody else.  Mrs. Martinek said for the Clerk the last time was 1951.  City Clerk Mrs. Martinek called the roll call.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and one absent (Alderman Turner); motion carried.

Mayor Snyder then asked for the Presentation of Claims, Presentations, Reading, Reference and Reports Thereon:

 

Alderman Anderson said I move to approve all claims as presented by Roll Call as well as presentations, readings, reference and reports thereon: Finance, Policy & Procedure, Streets and Alleys, Sewerage Treatment Plant, Sewers & Drainage, Police, Ordinance and Zoning, Sidewalks, Forestry and Lighting, Fire/Water and ESDA, and Grounds, Buildings & Local Improvements Committees' Reports by roll call and Alderman Horn seconded it. Mayor Snyder asked if there was any discussion.  City Clerk Mrs. Martinek called the roll call.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and one absent (Alderman Turner); motion carried.

 

Mayor Snyder then asked for the Presentation of Official Reports:

City Treasurer Mr. Plotner gave an oral Report for April 2009.

 

City Clerk's Report for April 2009 was handed out.

 

Mayor Snyder asked for the Presentation of Special Reports:

The written reports by the department heads were handed out.

 

Mayor Snyder asked for the Presentation of Unfinished Business:

 

Mayor Snyder said there was no Unfinished Business to come before the City Council.

 

Mayor Snyder asked for New Business:

 

Approval of Highway Authority Agreement for Illico Property (tabled 2/2/09)

 

Alderman Henrichsmeyer asked to leave this on the table. 

 

Engineering Agreement for upgrades to lift stations

 

Alderman Busby said before I put a motion on the floor I will explain that we have not received an agreement from O’Donohue nor has the City Attorney so I am going to move to table that and Alderman Henrichsmeyer seconded it.  City Clerk Mrs. Martinek called the roll call.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and one absent (Alderman Turner); motion carried.

Appointment of Department Heads

 

Mayor Snyder said there are a few department heads that I would like to make an appointment for tonight.  First for the Fire Chief I would like to appoint Chief Kent Hulett.  I would like to ask you to confirm that appointment for him to stay on as Fire Chief.  He’s done I believe an excellent job as Chief and I’m honored that he’s accepted my offer to stay on and continue to work on that role as leader of the Fire Department.  He has his own cheering section with him tonight.  He has his wife Donna, his son Jeff, his daughter Lindsey, and granddaughter Ally who I think they said was born on the date that he got the job last year.  That will be a good marker for his tenure.  I would like to offer that appointment to the Council. 

 

Alderman Horn said I would like to make a motion to approve the Fire Chief’s appointment and Alderman Neitzel seconded it.  Mayor Snyder asked for any discussion or comments.  City Clerk Mrs. Martinek called the roll call.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and one absent (Alderman Turner); motion carried.  Attorney Mr. Bates swore in Fire Chief Hulett. 

 

Mayor Snyder said next I would like to appoint Les Last to continue as Safety and Building Officer.  Mr. Last has been with that office I believe 14 years a couple of years was part time in the office and 12 years has been full time.  While this appointment is technically for a whole year Mr. Last has voiced to me an interest in retiring at the end of February 2010 so when we get around to talking about appropriations I’m going to ask the Council maybe for some wiggle room so we maybe can get a little overlap between Mr. Last and his successor so we can get some sharing of knowledge and some experience.  Mr. Last would be my appointment for Building and Safety Officer. 

 

Alderman Tibbs said I make the motion to approve the appointment and Alderman Armbrust seconded it.  Mayor Snyder asked if there was discussion or comments.  City Clerk Mrs. Martinek called the roll call.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and one absent (Alderman Turner); motion carried.  Attorney Mr. Bates swore in Mr. Last. 

 

Mayor Snyder said next I would like to appoint Tracy Jackson to serve as Street Superintendent.  Mr. Jackson has served in this role for several years now and I would like to ask that he be given the opportunity to continue serving.  Alderman Neitzel said I make a motion to accept Tracy as Street Superintendent and Alderman Anderson seconded it.  City Clerk Mrs. Martinek called the roll call.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and one absent (Alderman Turner); motion carried.

Retainer Agreement with Woods & Bates for Legal Services for the City of Lincoln

 

Mayor Snyder said the last so called Department Head that I would be prepared to deal with tonight would be isn’t really a department head but it would be embodied in Agenda Item 12D that is the Retainer Agreement with Woods & Bates for legal services for the City of Lincoln.  That agreement provides that Woods & Bates will be providing the legal services for the city I had previously provided you all with a copy of that and if you have any questions I can certainly answer those, if not I would accept a motion to approve the agreement for legal services. 

 

Alderman Anderson said I would move to approve the retainer agreement for Woods & Bates and Alderman Henrichsmeyer seconded it.  Mayor Snyder asked if there was any discussion.  City Clerk Mrs. Martinek called the roll call.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and one absent (Alderman Turner); motion carried.

 

Compensation for Department Heads

 

Alderman Anderson said I would move to approve the compensation for all department heads as permitted in our budget to 4 ½% for this fiscal year and Alderman Busby seconded it.  Mayor Snyder asked if there was any discussion.  Alderman Anderson said would just like to reiterate for the public that the reason for the 4 ½% was that we had tried to go in line with the unions for our department heads at 3 ½% last year and then 3 ½% this year but because the appropriations were not sufficient to allow us to do that last year they only got 2 ½ for last year so the 4 ½ was appropriate for this fiscal year.  Mayor Snyder asked if there was any discussion.  City Clerk Mrs. Martinek called the roll call.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and one absent (Alderman Turner); motion carried.

 

Appointment of Mayor Pro Tem

 

Alderman Hoinacki said I move to approve the appointment of Alderman Orville Busby as Mayor Pro Tem and Alderman Henrichsmeyer seconded it.  Mayor Snyder asked if there was any discussion.  City Clerk Mrs. Martinek called the roll call.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and one absent (Alderman Turner); motion carried.

 

Mayor Snyder said I just want to although I wasn’t a member or any way involved in the city I wanted to thank Alderman Neitzel for her work as Mayor Pro Tem over the course of the last year.  I think I saw you out on many things and I know you went above and beyond the call of duty so you served the city well in that role I just wanted to say thank you.

Mayoral Appointments to Boards and Commissions

 

Mayor Snyder said that should actually be singular because I only have one appointment this evening.  It is to be a member of the Police and Fire Commission with the term expiring May 1, 2011 and that is appointment is Don Cecil of 200 11th Street.  He will be replacing Darrell Sisk who was a member of that commission so I just have that one appointment to lay before you this evening.  I will probably have more as we continue on but that is the only one that I have here this evening Don Cecil to member of the Police and Fire Commission. 

 

Alderman Anderson said I would move to accept the appointment and Alderman Horn seconded it.  Mayor Snyder asked if there was any discussion.  City Clerk Mrs. Martinek called the roll call.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Henrichsmeyer, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and one absent (Alderman Turner); motion carried.

 

Alderman Busby said I had talked to you today with regard to something I found out about last week.  Bob Tackett is a licensed risk management instructor and has agreed to invite city employees to his meeting free of charge to the city which I think is a great thing so I would like all department heads to contact Mr. Tackett because we can only get a few individuals into the class but I would definitely like all the department heads to contact him and be at his meeting. 

 

Alderman Anderson said that is great.  Mayor Snyder said that is a valuable resource that we just found out about and we thank you for making that available.  Mr. Tackett said sure.

 

Mayor Snyder said several of you I think have gotten the notice just in terms of an announcement I guess got notice of this Logan County District 6 Town meeting that is coming up and it involves the Aldermen from Wards 3, 4, and 5.  I just wanted to make the announcement that the District 6 meeting is going to be at the Restoration Hall on the campus of Lincoln Christian College and Seminary on Wednesday, May 27, 2009 at 6:00 p.m.  Logan County Board Chairman Terry Carlton invites all residents of the district to a Town Hall meeting.  It is a chance to talk with your Logan County Board members as well as your Lincoln City Aldermen to ask questions that you have been wondering about and provide input.  So bone up on questions it says join others provide input on what you would like to see as top issues for your county and city leaders. Thank you to the Aldermen for participating in that and I just wanted to make that announcement so it will go out over the airwaves if nothing else. The whole public would be encouraged to attend that if you are a resident of Logan County District 6. 

 

Mayor Snyder said I think the last item I want to it is not an agenda item Alderman Henrichsmeyer passed out some letters this evening. He asked Alderman Henrichsmeyer if he could read the letter that he had sent.

Alderman Henrichsmeyer said sure. 

 

Mayor Snyder read the letter of Alderman Henrichsmeyer’s resignation as of June 15, 2009.  He said Alderman Henrichsmeyer I think I speak for all of us we will be sad to see you go and certainly I have only worked with you for a short time.  I think the Council has only worked with you a short time but I think everyone knows that you are a hard worker and very bright and you were very dedicated to the city.  We wish you nothing but the best. 

 

Alderman Henrichsmeyer said I appreciate it I definitely enjoyed serving with all of you and serving the citizens of Lincoln.  It is unfortunate that I cannot do it longer but I definitely enjoyed it while I could thank you. 

 

Mayor Snyder said you will still have a few meetings.  You are on the hook until the 15th of June.  We wish you nothing but the best. 

 

Mayor Snyder said Attorney Bates just raised an issue just briefly back to the District 6 Town Hall meeting if there are more than 2 of you that attend that we need to put out a notice about it being, put out an open meetings notice.  If any of you know that you are going to be a part of that.  It looks like we have more than two so we’ll go ahead and put out a notice. 

 

Alderman Busby said do we send them the bill. 

 

Mayor Snyder said yes, we can.  It doesn’t mean that they will pay it but we will send it to them. 

 

Mr. Bates said I guess I need to clarify is the purpose of discussing business of the city.  Alderman Busby said yes and the County.  Mr. Bates said it has to be noticed for a public meeting under the open meetings act. 

 

Mayor Snyder asked if there was any further business to come before the Council tonight.
