Minutes of a regular City Council Meeting held in the Council Chambers of City Hall, Lincoln, IL, on Monday, June 15, 2009.

 

Mayor Snyder called the regular City Council Meeting to order at 7:15 p.m.  City Clerk Mrs. Martinek called the roll.  There were seven Aldermen present (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Tibbs, and Alderman Wilmert) and three absent (Alderman Henrichsmeyer, Alderman Neitzel, and Alderman Turner).  Also present were Street Superintendent Mr. Jackson, EMC Manager Mr. Tackett, City Engineer Mr. Mathon, Deputy Police Chief Geriets, Fire Chief Hulett, and Safety and Building Officer Mr. Last.  Also present were City Treasurer Mr. Plotner, City Attorney Mr. Bates, City Clerk Mrs. Martinek, Mayor Snyder, and Recording Secretary Mrs. Riggs.

 

Those present recited the Pledge of Allegiance to the Flag led by Alderman Armbrust.

 

Mayor Snyder said we are going to move something up right after the pledge because we have some firefighters and their families here.

 

Mayor Snyder asked for New Business:

 

Oaths of Office for Andy Dexter, Beau Friday, Rick O’Hara, Ken Ebelherr, Aaron Johnson of the City of Lincoln Fire Department

 

Fire Chief Hulett said the Fire and Police Commission has approved the promotions and I am pleased to announce the promotions the Oaths of Office is a requirement of the Fire and Police Commission.  He called Rick O’Hara and said he was being promoted from Captain to the rank of Assistant Chief. He said Mr. O’Hara has 20 years of service and I believe today is the anniversary with the City of Lincoln. 

 

City Attorney Mr. Bates swore in Mr. O’Hara and Mayor Snyder handed him his new badge. 

 

Fire Chief Hulett said that he would next like to call up Ken Ebelherr who has been promoted to Captain and has 29 years of service.  City Attorney Mr. Bates swore in Mr. Ebelherr and Mayor Snyder handed him his new badge.

 

Fire Chief Hulett said next I would like to call up firefighter Aaron Johnson he is being promoted to the rank of Lieutenant and he has 9 years of service with the City of Lincoln.  City Attorney Mr. Bates swore in Aaron Johnson and Mayor Snyder handed him his new badge. 

 

Fire Chief Hulett said I forgot to mention that these promotions were a result of Assistant Chief Tom Martin retiring at the end of last month.  I would like to publicly thank Mr. Martin for his 31 years of dedicated loyal service to the City of Lincoln.  As I mentioned before we having a lot of changes, a lot of pending retirements and we are losing a lot of experience but these are well earned promotions and I expect a lot out of our officers.

Oaths of Office for Andy Dexter, Beau Friday, Rick O’Hara, Ken Ebelherr, Aaron Johnson of the City of Lincoln Fire Department

 

Fire Chief Hulett said next I would like to invite up two of our newest firefighters that you gave me the authority to hire last month and we’ve got two very talented individuals.  They come to us from, Andy Dexter is a native of Lincoln and was full time with Lincoln Rural Fire Department and firefighter Beau Friday comes to us from the Chatham Fire Department.  They are both trained experienced firefighters.  I would like to thank Assistant Fire Chief Miller for two weeks of intensive training and orientation they are now assigned to shifts and they are helping us out with our staffing issues so if I could call up Beau Friday and Andy Dexter. 

 

Mr. Bates swore in Mr. Dexter and Mr. Friday as promotional firefighters and Mayor Snyder handed them their badges.  Mr. Bates said all of the firefighters that have just taken the oath before you leave if you would come up and sign the oath.  Mayor Snyder said thank you very much for allowing us to take that out of order that is always a good thing to see folks coming on and folks moving up this is exciting so thanks allowing us to do that.

Mayor Snyder asked if there was anything that anyone wanted to remove from the consent agenda. 

 

Alderman Anderson made a motion to approve the Consent Agenda as presented and Alderman Horn seconded it.  Mayor Snyder asked if there was any discussion.  City Clerk Mrs. Martinek called the roll call.  There were seven yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Tibbs, and Alderman Wilmert), zero nays, and three absent (Alderman Henrichsmeyer, Alderman Neitzel, and Alderman Turner); motion carried.  Mayor Snyder said thank you one of the items on the Consent Agenda was a Proclamation for Scout Sweep Day on June 20 and I have that here and since it has now been adopted by the Council I would be happy to present that to you so if you want to come forward and let us know your names in the microphone I would be happy to give you the Proclamation.  Courtland Raymond with Pack 105 I am filling in for Chad Bennett tonight who is the troop leader and could not be here tonight.  Jason Schafer said he is the Assistant Scout Master of Pack 111 also here in Lincoln.

Proclamation for Scout Sweep Day on June 20, 2009

 

Mayor Snyder said state your name and maybe what you school you go to and whatever else you’d like to tell us. 

 

Boys present were Adam Schafer of Washington-Monroe, Jonathan Raymond of Washington-Monroe, William of Central, and Zach Schafer of Washington-Monroe. 

 

Mayor Snyder said thank you and he read the Proclamation.  He said thank you for your efforts and if anyone would like to join you where would they join you on Saturday. 

 

Mr. Raymond said we are meeting at Washington-Monroe School about 8:00 a.m. and if there is a lot of rain we will do it the following Saturday.  Mayor Snyder said thank you very much and he handed them the Proclamation. 

 

Mayor Snyder asked for the Presentation of Petitions:

 

Petition for sidewalk at 530 South State Street by John DeOrnellas (work to be done by and at the expense of the city)

 

Alderman Armbrust I would like to keep this on the table. 

 

Petition by Mr. & Mrs. Donald D. Kurtz for the City to vacate the right-of-way between 704 21st Street and 720 21st Street

 

Alderman Hoinacki said I am going to have to table this because I don’t know if we received who really owns this ground is that correct.  Mr. Mathon that has been resolved I was able to find a plat with a Deed of Dedication and it is the city’s right-of-way. 

 

Mr. Bates said possibly before you table it can I give the Council some information about the process.  Mayor Snyder said please. 

 

Mr. Bates said Mr. Mathon and I have not had an opportunity to discuss this last week we had talked about meeting after I got back.  If there is going to be a process to vacate a platted street the city can do it of course upon petition by interested parties it has to be done by ordinance.  That ordinance has to be adopted by 3/4ths vote of the City Council.  There has to be a hearing on that before the ordinance can be enacted which requires notice at least 15 days before the public hearing.  There is quite a bit that goes into it before you get to the point of actually adopting the ordinance I think historically there’s been some discussion at workshop meetings about whether or not the Council is interested in doing that before we get into the full blown investigation there has to be an accurate legal description, we have to investigate if there are utilities and if there are utilities those have to be served by the City.

Petition by Mr. & Mrs. Donald D. Kurtz for the City to vacate the right-of-way between 704 21st Street and 720 21st Street

 

Mr. Bates said Mr. Mathon may know some of these things but since we they haven’t talked yet at that point then we put together an ordinance that the public should notice the public hearing if you want to move forward with this.  

 

Alderman Hoinacki said I think we will have further discussion on this next Tuesday at our committee meeting.  I move to table at this point and Alderman Horn seconded it.  City Clerk Mrs. Martinek called the roll call.  There were seven yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Tibbs, and Alderman Wilmert), zero nays, and three absent (Alderman Henrichsmeyer, Alderman Neitzel, and Alderman Turner); motion carried. 

 

Petition by Patrick Gettleman for a 20 foot culvert extension at 1807 N. Kankakee

 

Alderman Busby said I move to approve the petition by Patrick Gettleman to extend the culvert to have the city do the work and Gettleman pay for the culvert and Alderman Hoinacki seconded it.  Mayor Snyder asked if there was any discussion.  City Clerk Mrs. Martinek called the roll call.  There were seven yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Tibbs, and Alderman Wilmert), zero nays, and three absent (Alderman Henrichsmeyer, Alderman Neitzel, and Alderman Turner); motion carried. 

 

Mayor Snyder asked for the Presentation of Communications:

There were no Communications to come before the City Council.

 

Mayor Snyder asked for the Presentation of Bids:

City Clerk Mrs. Martinek stated that there were no Bids to come before the City Council. 

 

The Mayor then asked for the Presentation of Ordinances and Resolutions:

 

Ordinance Amending Title 8, Chapter 10 pertaining to Signs of the City Code of the City of Lincoln (tabled 4/28/09)

Ordinance Amending Ordinances which established an Enterprise Zone Encompassing Contiguous Portions of the City of Lincoln, County of Logan, Sangamon County and the Village of Elkhart

 

Alderman Hoinacki said I move to table this item at this time and Alderman Horn seconded it.  Mayor Snyder said any discussion.  Alderman Busby said no discussion on a motion to table.  Mayor Snyder said good point thank you.  City Clerk Mrs. Martinek called the roll call.  There were seven yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Tibbs, and Alderman Wilmert), zero nays, and three absent (Alderman Henrichsmeyer, Alderman Neitzel, and Alderman Turner); motion carried.

City Clerk’s Report for May 2009 is on file.

 

Oral report was given by City Treasurer Mr. Plotner for May 2009.

 

Presentation of Special Reports:

Written reports by Department Heads are on file. 

 

Presentation of Unfinished Business:

There was no Unfinished Business to come before the City Council.

 

Mayor Snyder asked for New Business:

 

Highway Authority Agreement for Illico Property (tabled 2/2/09)

 

Alderman Hoinacki asked to leave on the table.

 

Hiring of Appraisers for City Property

 

Mayor Snyder said we had had a discussion concerning that last Tuesday but I had received an email today which said that the party that was possibly exploring that city property is now pretty close to reaching an agreement with a private seller of land out on the West side of town so I don’t think they are going to be interested in our property any longer so I think we can remove this from the agenda.  He called on Alderman Tibbs. 

 

Alderman Tibbs said I move the hiring of appraisers for the city property be removed from the agenda and Alderman Busby seconded it.  City Clerk Mrs. Martinek called the roll call.  There were seven yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Tibbs, and Alderman Wilmert), zero nays, and three absent (Alderman Henrichsmeyer, Alderman Neitzel, and Alderman Turner); motion carried.

Mayor Appointments to Boards and Commissions

 

            Civil Service Commission

Mayor Snyder said I have just one tonight that I passed out to be a member of the Civil Service Commission Sarah Aughenbaugh of 44 Illini Drive she will be replacing Jane Quisenberry who resigned.  This is for a term through May 1, 2012 it would be a three year term.  That would be the appointment that I lay before you tonight on Boards and Commissions. 

 

Alderman Anderson said I would make a motion to approve the Mayoral appointment of Sarah Aughenbaugh to the Civil Service Commission and Alderman Horn seconded.  Mayor Snyder asked if there was any discussion.  City Clerk Mrs. Martinek called the roll call.  There were seven yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Tibbs, and Alderman Wilmert), zero nays, and three absent (Alderman Henrichsmeyer, Alderman Neitzel, and Alderman Turner); motion carried. 

 

Mayor Snyder said just a couple of announcements here at the end.  I received an email for anyone that’s interested tomorrow there’ll be a briefing on the state budget situation by the Governor’s staff in Chicago on the 5th Floor Auditorium of the Blanded Building.  If you can’t go you can listen to a streaming audio of it by visiting www.illinois.gov so if you want to know all about the state budget situation you can tune in tomorrow at 10:30 and listen to that link. 

 

Mayor Snyder said also just one last thing Alderman Wilmert had mentioned Tuesday night that he was looking into the issue of some grant possibilities for broadband access.  He and I talked and I thought that perhaps since there was not a lot happening on the Sanitation front at this point that perhaps his committee might be assigned this matter.  We’ll make it like Sanitation/Technology so maybe after Mr. Plotner talked about his computer not obeying maybe sometimes computers belong in the trash or somewhere. 

 

Alderman Wilmert said we will have a committee meeting at some point to discuss broadband.  I have one other announcement.  I wanted to direct this to any of the citizens that might be watching tonight.  As my short time as Alderman I have received a few letters some more colorful than others.  The issue of anonymous letters although they are nice to clue me in on things that are happening in the Ward don’t really help me to get in touch with you very much so I need a name, address or phone number or some way to contact you so we can get that communication I talked about when I ran and if you don’t want your name submitted or you’d like to keep it private that’s fine but it would still be nice to know who you are so try to do that for me please.

The City Council Meeting was adjourned at 7:44 p.m.
