The Regular Meeting of the City Council of Lincoln was called to order by Mayor Welch at 7:00pm, with proper notice given. City Clerk Peggy Bateman called roll.

Alderman Bateman made the motion to approve, Alderwoman Horn seconded .Mayor Welch called for discussion, there being none, City Clerk Bateman called roll.

Ordinances and Resolutions

A. Resolution 2022-447 supporting and creating a Committee to gather signatures to Petition the Court to put the matter of the abolition of the Civil Service on the upcoming ballot.

Alderwoman Rohlfs made the motion to approve, Alderman Downs seconded .Mayor Welch called for discussion.

City Attorney Hoblit conferred with other attorneys on this matter, they agreed with his research findings that signatures must be acquired. He will continue to do more research due to the statute not being very clear.

There being no further discussion, City Clerk Bateman called the roll.

B. Ordinance 2022-968 Authorizing and Approving Balance Transfer from the Sewer O&M Account to the General Fund in an amount not to exceed $1,000,000.

C. Resolution 2022-448 Granting Authority to the Mayor to order the remediation of material at the City

Alderman Downs made the motion to approve, Alderman Bateman seconded.   Mayor Welch called for discussion, there being none, City Clerk Bateman called the roll.

Bids

A. Approval of bid from Harold Goodman, Inc. for the demolition, removal and cleaning of property at 1431 Tremont Street in an amount not to exceed $6,900.00.

Reports

A. City Treasurer's Report for December, 2021

General Fund balance is still very good from a year ago. Mr. Conzo still encourages the Council to build it up.

Sales Tax & State Use Tax - up from last year Replacement Tax - the highest it has been in years State Income Tax increase - up from last year

Non Home Rule Sales Tax - is also up MFT - up as well

Video Gaming Tax - has leveled out

B. City Clerks Report for December, 2021

$335,599.80 was received in sewer payments for the month of December. $89,286.10 was received from the prisons.

C. Department Head Reports for December, 2021

These reports are either on file or will be soon. Mayor Welch moved to other items on the agenda.

New Business/Communications

A. Approval of revised "Request to Permit"

Mayor Welch informed the council that this is a non-street closure form rather than a street closure form.

 

Alderman Bateman made the motion to approve, Alderman Downs seconded.   Mayor Welch called for discussion.

This is a new form that was drafted by Alderman Rohlfs, reviewed by Alderman Bateman and Mayor Welch and dispersed to the council before the meeting. Alderman Bateman felt this was a better form than the original. The new form includes a food handler's license section and type of event section.

This item will be amended to consider the new form.

There was discussion to have two separate forms, one for events and one for projects. Projects would be classified as construction and needing to use or block city property to complete the project.

Alderman Hoefle had concern about this form creating liability for the City.  He feels that with the City signing off and giving permission for the use of city property to sell food, that if someone becomes sick from the food, the City could be held responsible.  He also brought up what a penalty would be if this permit was not obtained by someone using City property.

Alderman Bateman made a motion to amend the form that was in the packet to the form that Alderwoman Rohlfs dispersed to the council before the meeting subject to the changes named by Alderman Rohlfs; name of organization/business above contact name, dates/times of usage of property, and this form must be displayed. Alderman Parrott seconded.

City Clerk Bateman called roll on the amended motion.

There being no further discussion to come before the City Council of Lincoln, Alderman Hoefle motioned to adjourn, seconded by Alderman Bateman. Mayor Welch adjourned the meeting at 8:15 p.m.
