Minutes of a regular City Council Meeting held in the Council Chambers of City Hall, Lincoln, IL, on Monday, September 8, 2009.

 

Mayor Snyder called the regular City Council Meeting to order at 7:15 p.m.  City Clerk Mrs. Martinek called the roll.  There were ten Aldermen present (Alderman Anderson, Alderman Armbrust, Alderman Bacon, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, Alderman Turner, and Alderman Wilmert) and none absent.

 

Those present recited the Pledge of Allegiance to the Flag led by Alderman Tibbs.

 

Mayor Snyder asked for New Business:

 

Promotions for firefighters Larry Spurling, Chris Harding, and Oath of Office for Phil Uphoff

 

Fire Chief Hulett said if I could just say a couple of quick comments.  These promotions are the result of two promotions and two retirements.  Captain Jeff Singleton spent 28 years of service and Rick O’Hara is retiring in a couple of weeks with 20 years of service.  That is 48 years of service that we need to replace and these are very important positions in our fire department Captain and Lieutenant along with the rank of Assistant Chiefs they basically run the day to day operations and I have complete confidence in the new promotions and our new firefighter that we are going to fill an important role in our organization.  I would like to call up Lt. Larry Spurling and this is with the approval of the Fire and Police Commission last week.  We have Lt. Larry Spurling being promoted to the rank of Captain and if he could come up first we will administer the Oath of Office. 

 

City Attorney Mr. Bates swore in new Captain Spurling and Mayor Snyder gave him his new badge. 

 

Fire Chief Hulett said as a result of Lt. Spurling being promoted to Captain we have an open Lieutenant’s position.  Inspector Chris Harding is being promoted to Lieutenant.

Fire Chief Hulett said with Lieutenant Harding being promoted that opens a position for firefighter and I would like to introduce Phil Uphoff whose second day is today and he is going through a week’s worth of training under Assistant Chief Miller and the rest of our firefighters this week and he goes to the University of Illinois for six weeks.  Fortunately Mr. Uphoff has some basic firefighter training and he is also a licensed EMT and his training doesn’t stop when he come back to Lincoln and it continues here just like the rest of us.  I have high hopes for Mr. Uphoff and I would like to invite him up and he is from El Paso, Illinois and his mother and his aunt are here.

Promotions for firefighters Larry Spurling, Chris Harding, and Oath of Office for Phil Uphoff

 

City Attorney Mr. Bates swore in Mr. Uphoff and Mayor Snyder gave him his badge. 

 

Mayor Snyder said congratulations Captain Spurling, Lieutenant Harding and Firefighter Mr. Uphoff we are proud of our fire department and appreciate all that you guys do for us and have done for us already.  Congratulations.

Alderman Anderson said was that actually an adjourned Council meeting on the 17th or was it just a regular meeting.  Mayor Snyder said it was just a regular meeting.  Alderman Anderson said we would need to have that corrected other than that with the correction I would move to approve the Consent Agenda and Alderman Horn seconded it.  Mayor Snyder asked if there was any discussion.  City Clerk Mrs. Martinek called the roll call.  There were ten yeas (Alderman Anderson, Alderman Armbrust, Alderman Bacon, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, Alderman Turner, and Alderman Wilmert), zero nays, and none absent; motion carried.

 

Mayor Snyder asked for the Presentation by Economic Development Director Joel Smiley

 

Mr. Smiley said I have been absent for a couple of months and I do appreciate your time to let me give you a quick update and after I give you the update then I would be happy to answer any questions about anything we’re working on or any questions about the update.  To begin with our CEDS application was mailed to Peoria the additional workforce study comparing Logan County to four other counties was the last piece of the puzzle.  I worked with the Department of Labor to obtain a five county comparison the Economic Development Authority required Resolutions from all CED counties.  This near requirement was sent to Peoria last month our applications plans and approval have all been accepted by the Peoria EDC we are optimistic that we can formally be approved by the EDA later this year including a three year process.  Helitech is in the process of finalizing an agreement with private sector developer in Logan County and we are optimistic about this.  The partnership met with two of the top 5 wind producers in the United States.  We met with senior site consultants from both companies and took them for a site tour here in Logan County.  In addition we met with three other major wind developers we have taken tours of Logan County as well.  Last May I attended Wind Power 2009 which is the largest wind show in the United States.  These all came as a direct result of those shows.

Presentation by Economic Development Director Joel Smiley

 

Mr. Smiley said we are in the process of launching a Logan County SCORE office in Lincoln under the umbrella of Springfield SCORE Regional Office.  Two local volunteers are almost finished with their individual training SCORE is a national organization of retired business executives who volunteer their time to Counsel small business and start ups especially in establishing business plans and budgets.  The SCORE organization is looking to purchase a billboard here in Lincoln to promote the program.  This has been a very exciting process in trying to get small businesses here since I have been here we have been referring about 1 business a month over to the SCORE office in Springfield that have this program locally centralized would be fantastic.  I joined the Logan County Board for a tour and meeting at Logan County Correctional facility.  We are continuing to work with the Chamber in a joint effort to see what we can do to save jobs here in Logan. We are looking at other communities around the country to see what they’ve done in similar situations.  We are beginning site retention visits starting with the prisons.  Site visits began in August and we will continue these throughout October.  Our goal is to visit the top 40 employers in Logan County not just this year but we want to do this annually.  Our mission is two fold 1) we want to see if any of these companies are at least giving any indication that there might be some trouble and we’ll see what we can do to help them before it becomes into a job loss or location situation.  The flip side of this is we’re looking for talking to businesses about resources that available through the state through local and through the county to see what we can do to help them expand.  It is a two fold mission and we’re very optimistic that as we go through these that we will have some successes to report back to you.  I have been working with R.P. Lumber for the past 8 months and I am excited to say that they should be opening in September.  I spoke to the managers of all the other hardware stores and lumber stores about R. P. Lumber’s presence and offered them my assistance in terms of re-evaluating their own business plan.  As everyone knows Goody’s has now opened under new Ownership the partnership spent about five months facilitating that process.  We’re looking to host Economic Development Breakfast at Lincoln College either later this year or early next spring.  We have formally asked one major speaker and we are waiting for his staff basically to clear the date.  We think this is going to gain considerable excitement if we get who we think we are going to get and we would definitely like members of the City Council and members of the Department Heads of Lincoln to come to this great event.  I have been talking for a longtime about a business incubator and I am proud to say that our business incubator is on track to open in October.  Mayor Snyder has spent I am going to say you spent close to 16 or 17 months ago along with other volunteers in the community Nathan Turner among others and we are very excited that these 17 months are going to result in a very great program that is going to be coming here to Logan County.  Initially we were thinking about have a centralized location that is still the goal but I’ll talk about that in a second.  What has transformed is the act that we need to look at the resources we have, we need to look at available spaces that we have so our Logan County business incubator is going to be a collection of sites all over Logan County where the property owners are going to be agreeing to a three year program where they are going to offer reduced rent for those three years.  The applicants for the process those who want to start a business are going to have to go through the SCORE process.

Presentation by Economic Development Director Joel Smiley

 

Mr. Smiley said they are going to have to put together a business plan.  They are going to have to put and I know this is a very simple process but you would be surprised at how many businesses don’t even have a budget.  These guys are going to be required to do all of that and agree to participate in the SCORE process.  There will be continual business training and we are going to be networking these businesses together.  That is going to give us the great strength these businesses are going to take to survive these initial three to five years where most businesses fail.  By doing that we think we have a great formula to create jobs and targeted wages for those jobs are $12.00 to $15.00 an hour minimum jobs.  We have been talking about that since I came here and I am very excited and as soon as we have a launching date I would love the City Council members to come and kick off this great program.  Just met with Terry Carlton and our intern Daniel Parsons last week to discuss our website and I just submitted a $2,500.00 grant application to development our site and we are also waiting on two major grant applications one we are in the process of finalizing for our business incubator.  The second grant application was submitted and this is to do with something I talked to the Council about last year I would love our community to do an economic development master plan.  What this economic development master plan is it is kind of like a road map to success.  It tells you the strengths of the community it tells you the strengths area for growth and types of incentives that you need and then it goes a step beyond that it talks to you about the types of businesses we need to attract as part of that plan.  I have been wanting to do this since I came here to have a professional consultant is about $50,000.00 to $60,000.00 so we’re pessimistically optimistic that this USC grant will come through we should be hearing about that towards fourth quarter of this year.  With that I am going to stop and ask if there are any questions about economic development. 

 

Alderman Neitzel said when you are talking about Economic Development are you talking on the West side or are you talking about the downtown. 

 

Mr. Smiley said I actually represent all of Logan County so we are looking at various areas and it depends on the area.  For downtown we are looking at redeveloping or try to revitalize downtown area.  The west side you are talking about new development that is going on.  Out in the county and again this is we are here for the City of Lincoln but out in the county we are obviously talking about major wind farms and we’re talking about other types of major developers who can develop vast areas so we’re talking about all three.

 

Alderman Neitzel said you talk about Helitech are they coming to Lincoln or Logan County.  Mr. Smiley said right now the spot that they showed or at least they are most interested in is in Logan County on the border of the City of Lincoln. 

 

Mayor Snyder asked if there were any other questions.  Alderman Tibbs said I was reading where we have a water problem as far as the West side to the East side of Lincoln can you explain that to us.  Mr. Smiley said I am going to defer that one to Mr. Mathon.  Mr. Mathon said I honestly don’t know what you are referring to.

Alderman Tibbs said aqua fire and I was reading a major article about that did you read that.  Mayor Snyder said there was recently it is the Mahomet Aqua fir there was actually a meeting here in Lincoln that I don’t think was very well attended but they had a report about availability of water and the water tables. 

 

Mr. Bates said that was the East part of the aquifer not the East part of Lincoln that was like in Champaign and that county and area where they have such a higher demand than what Logan has.  The potential problem we’re talking about drawing on the aquifer is east of the aquifer not East of Lincoln.

 

Alderman Tibbs said but also it would affect Lincoln if we were to bring in any major businesses out there.  Mr. Bates said it would increase the draw but it is a phenomenal number of years down the road before it was going to be a concern for Lincoln and Logan County. 

 

Mr. Smiley said if we were to look at a major and I think one example I can’t go too specific industry or manufacturer that was looking at a considerable amount of water even before it gets to that point one of the things we do is sit down and talk to the engineer talk to Illinois American Water and see what capacity that is and especially if we are talking about an industry that would need a considerable amount of water.  Obviously we can’t do a project unless there are adequate resources there. 

 

Mayor Snyder asked for the Presentation of Petitions:

 

Petition from Sam and Jane Redding to replace curbs along the 300 Block of Lincoln Avenue

 

Alderman Turner said I move to reject the petition to replace the curbs along Lincoln Avenue and Alderman Armbrust seconded it.  Mayor Snyder said discussion on that. 

 

Alderman Armbrust said I have been out and inspected that twice today because I really wanted to look at it good and I have talked to the lady on the petition Mrs. Redding and we had a good conversation and the curbing in front of their home is in pretty decent shape.  The curbing in the boulevard is tore up in the places but that whole street needs to be looked at.  The thing I pointed out to Mrs. Redding was she likes her brick streets I said if we do this when we do we will have to take a couple of foot of brick out for the curbing and with that she was happy with whatever we decided. There is another petition for the other side of her property and that is the reason that I suggested that we reject it and I talked to Mr. Jackson and after he looked at it we looked at it together and I went back and looked at it again.

Alderman Turner said I move that we replace the curbs along Water Street and not Lincoln Avenue with the final dimensions to be up to the discretion of the Street Superintendent. Mr. Bats said before there is a second on that what part of Water Street from where to where.  Alderman Busby said it would be from Lincoln Avenue to the Alley.  Alderman Turner said alley yeah.  Mr. Bates said towards Peoria on the West side.  Alderman Armbrust said yes.  Alderman Busby said I think it only goes up to their driveway.  Mr. Jackson said half of it is already new we’ll only do parts.  Alderman Armbrust said I second it.  Mayor Snyder said is there any more to talk about than we already have.  Alderman Busby said this one is broke up more so than the one on Lincoln Avenue and it is the pan that is really broke up.  Alderman Armbrust said it definitely needs replaced.  Alderman Turner said a couple of the pictures that you saw on the street here are from that.  City Clerk Mrs. Martinek called the roll call.  There were ten yeas (Alderman Anderson, Alderman Armbrust, Alderman Bacon, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, Alderman Turner, and Alderman Wilmert), zero nays, and none absent; motion carried.

Resolution Creating a Stop Intersection at Willamette Avenue and Sheridan Street

 

Alderman Neitzel said I make a motion to accept the Resolution which was read at Committee creating a stop intersection at Willamette Avenue and Sheridan Street with the stop sign to be on Sheridan Street and Alderman Hoinacki seconded it.  Mayor Snyder asked if there was any discussion.

Presentation of Official Reports:

Presentation of Special Reports:

Alderman Tibbs said Alderman Armbrust and I have set up October 13 on Tuesday October 13, Ward 3 will be hosting our workshop meeting and it is not a special meeting it is just a regular workshop meeting instead of being held in City Hall it will be held in Friendship Manor at 7:00 p.m.

 

Mayor Snyder said I have asked all of you to host a workshop in your Ward and Alderman Tibbs and Alderman Armbrust are the first to have it officially set and ready to go.  I think Alderman Horn and Alderman Wilmert also have a date in October on October 27 now I don’t know if you have a location locked in. 

 

Alderman Horn said Postville Courthouse.  Mayor Snyder said we have two of the five wards.  Alderman Neitzel said we are working on ours.  Mayor Snyder asked if it was accessible I guess Friendship Manor would be.  Alderman Horn said I have to talk to Mr. Jackson to see the one problem that Shirley Bartlemay told me is that it is kind of dark getting up the steps at night so I was going to see if Mr. Jackson had a solution to that. 

 

Mayor Snyder said I have an announcement I got a letter from Northwest Municipal Conference to some of you that were on the Council dating back to 2004 might remember this the City participated in a multiple jurisdictional effort to defend the city in class action lawsuits regarding the implementation of the telecommunications infrastructure maintenance fee.  Does that ring a bell for some of you?  There were an oversight committee formed to manage and guide the litigation in terms of settlement.  Apparently the attorneys didn’t use up all the money so we got a refund on some of the money we contributed.  We got a check for $900.68 which they say is roughly 23% of our original contribution so just wanted to make you aware of that. 

 

Mr. Bates said I think we may have gotten some money out of that grant money out of that too didn’t we? Alderman Busby said yep. 

 

Alderman Wilmert said I need to get this information to whoever is over fire house police station project.  John Bishop from Farnsworth and Associates got me some information on thermal efficiency program for public facilities and it is a grant and application and program guidelines on that.

Alderman Wilmert said using specific materials during construction of a new facility and the monies are from the American Recovery and Greenhouse act. 

 

Presentation of Unfinished Business:

There was no Unfinished Business to come before the City Council.

 

Mayor Snyder asked for New Business:

 

Highway Authority Agreement for Illico Property (tabled 2/2/09)

 

Alderman Turner asked to leave on the table.

 

Solution to Sewer problems at 1023 N. Monroe

 

Mr. Bates left at 7:46 p.m.

 

 Alderman Neitzel said I make a motion to make payment of $1,653.48 half of the repair cost of the sewer for the resident along with future sewer credit for seven years or until her residing stops there at the location of 1023 N. Monroe subject to a signed waiver signed by the resident of the property and Alderman Wilmert seconded it. 

 

Mayor Snyder said you’ve heard the motion and we have a second, discussion about this.  Everyone clear on what the motion is and I guess this would have to be taken to the party and they would have to accept it. 

 

Alderman Neitzel said they would have to accept it and sign a waiver before we would issue any payments which I have already talked to the other attorney.  Mr. Plotner said the payment in this motion coming from the sewer fund is that where the money is going to generate or what.  Alderman Neitzel said yes, have to.  Mayor Snyder said any other discussion, comments or questions?  City Clerk Mrs. Martinek called the roll call.  There were seven yeas (Alderman Anderson, Alderman Bacon, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), three nays (Alderman Armbrust, Alderman Busby, and Alderman Turner), and none absent; motion carried.

 

Mr. Bates returned at 7:47 p.m.

 

Decision on fast track demolition services

 

Mayor Snyder said we had discussed this at the workshop meeting previously and we had kind of basically left it that if the money could be found available to address the demolition of properties which would be the significant cost we might be interested in moving forward.  We have there is a CD that Mr. Plotner discovered with regard to a development that happened several years ago that can be paid into the city’s general fund in the amount of $31,000.00.

Decision on fast track demolition services

 

Mayor Snyder said Mr. Last had gotten several bids on two properties and two of the properties that we feel would most likely be the best candidates for this and the bids were $4,700.00 in one case and $4,800.00 in another case so totaled together would total $9,500.00.  I think we could take $10,000.00 of that $31,000.00 CD and direct towards demolition of these two properties if it were to come to that.  We have in appropriation for demolition of property $100,000.00 so that’s covered already in the appropriation the Council has already passed so I think we would be asking for approval tonight to proceed with this process with this money that would be available from the CD.  That was a long explanation of the agenda item.  The two properties that we thought in conversation with Mr. Last and actually Mr. Bates’ office one was at 417 N. Madison and the other was 718 S. College Street which is at the corner of College and First Street.  If we were to get approval for the process it would initiate the title search as Mr. Bates outlined at the workshop meeting then posting of notices and going forward that way. 

 

Alderman Anderson said I would move to approve implementing the fast track demolition services under the line item in the appropriations for demolition using the funds from this maturing CD and Alderman Wilmert seconded it.  Mayor Snyder said discussion about this.  Alderman Turner said is the money for the process going to come out of the same I remember there was a couple hundred dollar title fee and I don’t know how much it’s going to be to get the whole settlement to demolition but is that going to come out of the same place.  Mayor Snyder said there would be some Mr. Last has some in his budget I know in the nuisance abatement line that would have maybe be able to take care of any smaller costs that wouldn’t be covered by the $10,000.00 so you are right it was a couple hundred dollars for title search and publication in the newspaper. 

 

Mr. Bates said recording the notice so it was probably it was close to probably $400.00 keep in mind before you say we get to demolition we get to demolition if somebody doesn’t stop us.  There are no guarantees that we will have to spend it.  Hopefully we won’t.

Mayor Snyder said let’s just clarify that we are talking about the property which would be the park like area with the Amtrak Shack the watermelon statue perhaps although that would be the primary and the secondary would be the green space on the other side of the track if that would be reasonable as well.  We are not talking about the building itself here with this authorization.  Just to further this I thought I have already talked to Mr. Plotner, Alderman Busby and Alderman Tibbs and see if they would serve on a committee with me to take this forward assisted by Mr. Bates to help proceed with those discussions.  Any other discussion?

Council Committee Assignments

 

Mayor Snyder said with the addition of Alderman Bacon we need to get her plugged into some committees so I passed out to your place a revised assignment.  I have asked Alderman Bacon to chair the insurance committee and that was previously chaired by Alderman Turner and I have asked him to chair the Street and Alley committee.  Alderman Turner will also then be the Vice Chair of the Insurance committee and Alderman Armbrust will move from Vice Chair of Insurance to Vice Chair of Streets and Alleys.  I also made another change I believe that Alderman Tibbs was the Vice Chair of Sanitation and I have asked her now to be Vice Chair of Police Committee and Alderman Bacon will be the Vice Chair of the Sanitation Committee.  Because of those initial changes there were also a few other tweaks around and I think Alderman Busby got moved around on a committee and Alderman Turner as well.  I think since we’re back to full strength we’ll be ready to go.  Any questions about any of this? 

 

Alderman Hoinacki said I think maybe Mr. Plotner or City Clerk can verify that the State of Illinois has made a payment on their sewerage bill.  I thought you should probably know that.  Mr. Plotner said $175,000.00 and thought Representative Bill Mitchell had a lot to do with it and he is the only one that replied. 

 

Mayor Snyder said just in terms of announcements tomorrow night at the High School some of you may have gotten word about this.  There is an event going on it is called Rachel’s Challenge and I know they were inviting community leaders to participate in that and it is from 7:00 to 8:00 p.m. tomorrow it’s a character development program and they are having programs throughout the day at the high school and other school districts and they are going to have community wide event tomorrow night at 7:00 so you are certainly invited to that.  Also remind that we are going to have the economic development summit on Saturday from 8:00 a.m. to 12:00 p.m. out at Lincoln College in the Alumni Room in the Student Services Building so if you can be at that we would be happy to have you there and you are all welcome and invited as well as the public.

Mayor Snyder said any other business to come before the Council and he called on Alderman Horn.

 

Alderman Horn said I would just like to remind people to fly their flags on 9/11.  Mayor Snyder said very good point Patriots Day I believe it’s officially known as. 

 

Alderman Busby made a motion to adjourn and Alderman Anderson seconded it.  There were ten yeas (Alderman Anderson, Alderman Armbrust, Alderman Bacon, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, Alderman Turner, and Alderman Wilmert), zero nays, and none absent; motion carried.

 

The City Council Meeting was adjourned at 7:55 p.m.
