Minutes of a regular City Council Meeting held in the Council Chambers of City Hall, Lincoln, IL, on Monday, October 19, 2009.

 

Mayor Snyder called the regular City Council Meeting to order at 7:15 p.m.  City Clerk Mrs. Martinek called the roll.  There were ten Aldermen present (Alderman Anderson, Alderman Armbrust, Alderman Bacon, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, Alderman Turner, and Alderman Wilmert) and none absent. Also present were Fire Chief Hulett, City Engineer Mr. Mathon, Street Superintendent Mr. Jackson, EMC Manager Mr. Tackett, Safety Building and Zoning Officer Mr. Last, and Police Chief Erlenbush.  Also present were City Treasurer Mr. Plotner, City Clerk Mrs. Martinek, Mayor Snyder, City Attorney Mr. Bates, and Recording Secretary Mrs. Riggs.

 

Those present recited the Pledge of Allegiance to the Flag led by Alderman Turner.

 

Update from Comcast Communications - Libbie Stehn

 

Ms. Stehn said thank you for inviting me here tonight.  Basically with the price adjustment that we just announced effective with November billing statements you will see an average rate increase of 2% it is $1.99 so anybody that has basic and expanded basic service will go from $51.00 to $52.99.  I think it is important to note that this is our lowest increase in ten years and we also have not, since Comcast took over we have not had an increase since April of 2008.  It has been an eighteen month period before we have raised rates.  It will affect only a small number of customers because most of our video customers people who have basic only, digital starter, digital preferred or any type of promotional package they will not see an increase.  The other thing we're doing right now we have 2 digital levels we have a digital preferred and we also have a digital classic we are combining those two services into just one level tier level and that increase will go up by 96 cents the digital classic will increase from $14.99 to $15.95 but because we are combining the two levels of service their actually going to get 14 new channels that they didn't have before.  We are not changing our price for our high speed internet service or our digital phone service.  We're not changing any of the prices on our equipment and there won't be any increase in prices for any of our premium channels.  I realize that you know especially in these economic times price increases are never well received but just like any other customer our company we're seeing an increase business and operational costs, increasing programming costs, and yet we're still investing in the newest and latest technology and customer service improvements.  One of the big priorities for Comcast this year has been improving customer service because we feel in a competitive market that's what we need to focus on is to keep and maintain our customers.  We're really doing investing a lot with our customer service training and technology and personnel.  We've recently rolled out hand held devices and laptops for our technicians so they have the most effective tools at their fingertips. We're also utilizing new technologies to keep the plant reliable and letting us better diagnose any issues.

Update from Comcast Communications - Libbie Stehn

 

Ms. Stehn said in April 2009 we actually launched a customer service guarantee because we want to demonstrate to our customers that we're dedicated to getting it right the first time and we are empowering our employees to make it right did we miss the mark because granted we know there are going to be mistakes but hopefully by they're fewer than we used to have.  For example if a customer after the first visit to a customers home if we don't completely satisfactorily complete their installation or can't resolve a routine issue we will extend a complimentary three month premium service or a $20.00 credit to their account.  If we fail to arrive for a scheduled visit during the promised appointment window we will provide the customer with a $25.00 credit for their inconvenience.  Also, since Comcast has taken over the cable system from Insight we have launched over 20 full time HD channels.  We've just recently launched some new sports channels that were very highly requested such as Big 10 network, Major League baseball, ESPNU and the NFL red zone just to name a few.  We also now offer over 10,000 On Demand movies in addition we are offering On Demand in HD.  Our biggest request from customers is to add additional channels and to add additional On Demand products. 

 

Mayor Snyder said just a question about the billing and then if anybody else has any questions about the bills.  You said the expanded basic goes up $1.99 and that's for individuals that don't have the box is that right.

 

Ms. Stehn said correct.  She said it is actually going from $51.00 to $52.99.  Our digital starter package is actually priced at $52.99 too so a customer if they wanted to go into digital it would be the same price as what they are paying for not having digital plus they are getting more channels plus they have access to over 40 music channels and that gives them the On Demand products so for the same price they can be getting a lot more products and content. 

 

Mayor Snyder said is it an effort to try and move people into that digital.  Ms. Stehn said no at this point in time what we you know try to focus on selling our digital products but at this point about 70% of our customers already have digital so it is one of our highest level packages actually.  Mayor Snyder called on Alderman Tibbs.  Alderman Tibbs said is there an extra cost for the box.  Ms. Stehn said no the $52.99 includes the box in digital starter.  Mayor Snyder called on Alderman Turner. 

 

Alderman Turner said I just had a question in general about the 96 cent rate increase this year.  I mean you mentioned that your costs are constantly increasing and we are seeing a period of major recession negative inflation throughout the entire economy with electricity prices, fuel prices plummeted, senior citizens are not seeing any increase in pay this year but still we're in a situation where a natural monopoly that is cable and you're still increasing your rates and I am just wondering how the public is typically very unhappy when their cable rates go up especially since their lack of choices other than going to satellite are pretty minimal and there are a lot of negatives that come with that so I am just very surprised this year especially the city is not going to get any more tax revenue people aren't going to get any more money that the cable company would come ask for more money for their same cable service.

Ms. Stehn said I can definitely understand your concern and I know it is a tough economic times but you know our costs have increased.  I mean programming costs continue to rise every year and our health costs continue to rise.  I mean we are fortunate that we are a company that still employs you know in Lincoln we have ten employees and Springfield, Lincoln and Decatur combined we employ over three hundred employees and are continuing to hire those front line employees to help service our customers better.  We're not in a position where we've been laying off people and we hope not to have to hit that point.  I mean we have been trying to control costs as much as possible and to have as little impact on customers and as I said earlier this is our lowest rate increase that we have had in ten years.  It is our first one in 18 months. 

 

Mayor Snyder called on Alderman Horn.  Alderman Horn said if you switch to the digital if you were just on the basic and you switched to the digital would you be getting the channels that were taken away before like EWTN.  Ms. Stehn said correct that is all on that and you take the digital starter you will get those local broadcast channels as well as like the EWTN and the ones we moved. 

 

Mayor Snyder said let me ask you a couple of questions that people have asked me.  I had looked it up and part of the franchise agreement I didn't realize it was part of the franchise agreement now is that Comcast will provide the broadcast for the Council meetings. 

 

Ms. Stehn said correct.  Mayor Snyder said if people wanted to get a copy of a tape or a DVD of a Council meeting would they go to Comcast to get that.  Ms. Stehn said actually we're doing these live so we're not actually taping them so in order for a citizen to get a tape they would need to record the actual Council meeting when they are watching it.  Mayor Snyder said ok so it is not anything that you keep a library of.  Ms. Stehn said right it is actually a live feed that we are doing at the Council meeting. 

 

Mayor Snyder said the second issue I have had people talk to me about and that is about the issue of public access channels.  The franchise agreement talks about initially and this obviously would have been back I think the franchise agreement was negotiated back when Continental was in place. 

 

Ms. Stehn said I think it was and it is a 25 year agreement which quite honestly these days is unheard of. 

 

Mayor Snyder said it initially talks about one channel that would be shared by local origination, government access, educational access, and public access and then it says upon completion of a cable system rebuild which I think was done in 1994 the company would make available as permitted by channel capacity and technical limitations one access channel for the provision of public educational and governmental access television and I think CITV 5 is local origination right.

Ms. Stehn said right actually the one channel we have now CITV 5 it shares with public origination access, government access and education access.  We actually have some churches here locally that actually bring us DVD's and we actually play them back on Channel 5 during Saturday and Sunday or whenever they request us.  People do have access to public access if they're interested I mean they can bring us in a produced DVD and we will play it back. 

 

Mayor Snyder said ok it talks about government access to be used by local government, educational access use t be used by local education authorities and public access by anyone in the community on a first come first serve basis but then it talks about that additional channel after the rebill and the rebill happened 15 years ago.  Is there a second channel that you make available for public access?

 

Ms. Stehn said not at this point but it has not been requested from the previous administration. 

 

Mayor Snyder said so we would have to request that.  It is in the franchise agreement. 

 

Ms. Stehn said we would look at the cost and that because there is cost.  Mayor Snyder said in Springfield is there a public access channel where folks can come in.  Ms. Stehn said yes Springfield has a public access channel that is for our public access it is our channel 4.  Mayor Snyder said we don't have that here. 

 

Ms. Stehn said like I said right now we have people that are actually utilizing channel 5 as public access as well.  We have several church groups and other groups that actually are playing back where we pay back stuff that they have requested we air for them. 

 

Mayor Snyder said they have to produce it then get it to you like a school couldn't do an in studio program anywhere similar to what you provide in Springfield.  Ms. Stehn said not at this point.  Mayor Snyder called on Alderman Anderson.

 

Alderman Anderson said the question that I have goes along with the access for the governmental use.  I have had more requests than I think anything, even the racetrack with regards to Council meetings only being shown live on Monday that they would like to have the Tuesday workshop meetings televised that's in essence where a great part of the work goes on that the public isn't seeing.  Is there a reason that we don't have all of our meetings televised?

 

Ms. Stehn said no basically Alderman Horn and I had discussed this at one point and I know she was going to take it back but I mean if you guys are interested in actually having another one we can certainly look at that.  Alderman Anderson said I know I am certainly interested.  Mayor Snyder said in addition to or both.  Ms. Stehn said what I understood from Alderman Horn was instead of in addition that you would prefer to have that one.

Update from Comcast Communications - Libbie Stehn

 

Alderman Anderson said if we have a choice I would prefer that one but ideally the people that are paying for this luxury in their home it would be nice if they could see where their tax dollars are being spent for all their meetings.  Ms. Stehn said when are those other meetings?  Mr. Bates said 2nd and 4th Tuesday.  Ms. Stehn said we can look into that like I said we did discuss that and she said she was going to discuss it with you guys and get back to me.  Mayor Snyder asked if there were any other questions. 

 

Mr. Jackson said On Demand it has on there you can currently catch the shows that are on there like 2 1/2 men but why is it that Mercy is the only one that is a 99 cent charge to watch and all the rest of them are free. 

 

Ms. Stehn said I think there are certain ones that are free then there are other ones that have prices to them. There are several programs that are free then there are others that we charge for.  I can't answer you why in particular that Mercy is one of them that we charge for.

 

Update from Economic Development Director Joel Smiley

 

 Mr. Smiley said it has been a while since I have been here but it has been a very busy several weeks.  I am very excited to talk to you about 5 major projects that we are moving forward with and I want to read through this very quick and then I will be happy to answer any questions you have on these or ideas.  We just received confirmation a couple of weeks ago from the USDA that Logan County was one of two counties in Illinois to receive a $50,000.00 grant that we are calling the Economic Development Master Plan.  When I came on board here back in February of last year I talked about the initial concept of what an economic development master plan will do.  As you look at your comprehensive plan and it will actually give you a road map and I know the Mayor put on a very exciting economic summit.  The consultant we bring in will also take a look at those results and have community meetings and talk about where we go and what we can do and how we can get there.  With the amount for the grant we are going to get a top notch consultant firm that has done these all over the country and this is going to be the next step in the process to really move Logan County forward and of course part of that is a major portion of that is helping and assisting Lincoln especially in the downtown area especially looking at the LDC property and look at manufacturing as well. 

 

Mr. Smiley said next on October 29 specifically at 11:00 I have been talking about this for about a year and a half and Alderman Turner can attest to that we’ve dragged him through a series of meetings.  We’re going to be launching our business incubator.  I will have tomorrow the location confirmed where we’re going to do it.  The business incubator that I have been talking about is a decentralized location we’re going to have facilities all over Logan County not just in one facility.  That is exciting because other incubators around the country use just one facility and they don’t really utilize the available properties that you have all over the county.

Update from Economic Development Director Joel Smiley

 

Mr. Smiley said with this process we’re going to be able to accommodate basically a start up office that is going to have maybe 100 square feet and they are going to have a shared copier and maybe a shared printer all the way off and I am proud to say and I will go on record to say that the Myers also known as Hucks has agreed to participate in the program as well.  I am very excited about that and that gives us up to 100,000 square feet.  The final thing I will say about the program is that this a three year program where the first year the rent will be reduced by 50%, second year a 30% break and the third year they will get a 10% break.  They will also be required to go through and here is another launching point we’re going to be announcing that next Wednesday at 11:30 I believe we are going to have a ribbon cut for SCORE.  That will be at Devonshire reality we now have two formal SCORE volunteers Ed Dowling and Sonnie Alexander who have completed the SCORE application process and the SCORE Training process this will be the first time in Logan County’s history that we will have a full time functional SCORE office.  Why is that important because as start ups come through it’s important for them to understand what a budget is and what a business plan is and that is what SCORE does better than anyone else.  Part of that process as well is we’re also going to have some volunteer advisors including an accountant, an attorney, and a banker and they are going to rotate to assist with these start ups through SCORE so we can get them additional expertise and guidance as well.  Our goal is to create 100 new jobs a year through this program and I think its been a phenomenal effort I am going to pick on a couple of people here Alderman Turner and Mayor Snyder who have not just since they have come on the Council pretty recently but has been involved in this process actually since March or April of last year and this process couldn’t happen without a lot of volunteers and we’re really excited and want to see a lot of people out there for this ribbon cut. 

 

Mr. Smiley said the next major announcement that I want to make is that we are very close to announcing a Helitech deal and it is going to be out in the county.  I am expecting an announcement to be made here in the next three to four weeks.  They are just finalizing everything and I don’t want to go public yet with the address and everything but this has just been about a 12 month process to really get this deal done so we’ll have a formal announcement hopefully in the next three or four weeks. 

 

Mr. Smiley said one final project we are working on and people are like this is just a minor project it is not really significant.  Business retention is crucial for Logan County and when I say Logan County I mean the City of Lincoln, talking about Elkhart, talking about Mt. Pulaski, and I am talking throughout the county.  We need to make sure that we understand who our major employers are, what their needs are, and be able to identify and be able to proactive steps to either help or expand or prevent them from retracting.  We launched something called a site visit effort and what we’re doing right now is we are meeting with top 40 something employers on an annual basis and this is the first year we’re through it.  We just started meeting with them around the first of September we will have this process for first round by the end of November.

Update from Economic Development Director Joel Smiley

 

Mr. Smiley said I will tell you there have been two exciting ideas that came from the employers of things they would like to see that we are going to introduce to the community hopefully in another month I want to make sure it goes through my board and the formalities of it first.  This is very exciting for us understand what these ideas are get our major employers together and let’s try to focus on job creation and job retention where we know they have a vested interest in Lincoln and Logan County so with that I am going to stop and ask if there are any questions. 

 

Alderman Neitzel said when we first started talking about Helitech definitely Lincoln, definitely Lincoln and now it is not.  Am I right or wrong?

 

Mr. Smiley said you are right the first location there were with the Helitech. 

 

Alderman Neitzel said let me this to the question before you answer it.  What’s wrong with Lincoln and why didn’t they pick it. 

 

Mr. Smiley said the reason that they chose not to was when they originally described their project they had guaranteed a certain amount of jobs and job creation.  They said due to the economy they would have to reduce those number of jobs and the partnership board said if they are going to reduce the number of jobs that there are other areas the area that they have selected the ground was very valuable and they said they would be better looking at other areas and that’s when we went back to the drawing board looking at private sector opportunities we found three different private sector opportunities after the Helitech and now they are focusing on one of those three opportunities.  I can tell you I have been in development deals for 11 years working on behalf not from the private sector but the public sector side and I have seen deals that have taken I have worked on Farmcia and Pfiser for close to about three and a half years.  I have worked on deals for as long as three and a half years or as quickly as three months.  It is just the nature of putting all these t’s together.  They had been approaching Logan County before the partnership got involved for two years prior to that so they then tried to get here for almost four years. 

 

Alderman Neitzel said I just want you to keep in mind that Lincoln is part of Logan County. 

 

Mr. Smiley said absolutely and you’re going to notice that a bulk of the business incubator is in Lincoln.  SCORE is going to be housed in Devonshire in Lincoln.  As we talked two successive partnership had one was the recruitment of R.P. Lumber that ended up here in Lincoln.  Another one, well everyone says well Goody’s has reopened.  Actually that wasn’t the case Goody’s is under completely new ownership and it was an almost 6 month process to bring them here.  The partnership is very concerned about making Lincoln as your county seat the vibrant population center and that is what economic master plan is also going to help us do. 

 

Alderman Busby said Mr. Smiley do you have anything on the horizon for the 26 acres on the South side of Wal-Mart.

Update from Economic Development Director Joel Smiley

 

Mr. Smiley said I would tell you the same thing very valuable ground and that from an economic development standpoint would definitely like to see some manufacturing opportunities and some commercial opportunities.  I will tell you that I want to talk back about the site visits for a minute.  This actually came from a site visit that we had yesterday so fresh off the box and I don’t want to tell you and go public and say the name of the company but identify a very large manufacturer that is actually looking for a site.  We are in the process of trying to make contact to this company we know that they are looking right now for a warehouse distribution center.  We know they have considerable amount of funds behind them and could do a fantastic project.  Having land that is available like this 26 acres is very crucial for economic development in the future.

Acceptance of bids for 2009 Pavement Patching and Overlay

 

Alderman Turner said I recommend awarding the 2009 pavement patching and overlay project to Professional Pavers and Maintenance Services for the amount of $36,678.85.  Mr. Bates said before there is a second on that can we clarify that is specific locations isn’t it.  Alderman Turner said yes that is for McLean Street intersections of Delavan and Pekin.  Alderman Armbrust seconded it.  Mayor Snyder called on Mr. Mathon.  Mr. Mathon said just to point out the bid total from Professional Maintenance Service read was $36,678.00 and in going through their tabulation bids the cents portion was not carried out on a couple of figures so that is the corrected figure of $36,678,85.  Mayor Snyder asked if there was any other discussion on this.    City Clerk Mrs. Martinek called the roll call.  There were ten yeas (Alderman Anderson, Alderman Armbrust, Alderman Bacon, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, Alderman Turner, and Alderman Wilmert), zero nays, and none absent; motion carried.

Alderman Busby said I move for acceptance of the bid for $577.00 from D & D Sales for the 1999 Ford F-250 Sewer plant truck and Alderman Neitzel seconded it.  Mayor Snyder asked if there was any discussion.  Mayor Snyder called on Alderman Armbrust.  Alderman Armbrust said Alderman Busby remind me the transmission that was in there.  Alderman Busby said it is gone.  Alderman Armbrust said I want the folks to understand that.  Alderman Busby said it will need a new transmission.  Mayor Snyder asked if there was any other discussion on this.    City Clerk Mrs. Martinek called the roll call.  There were ten yeas (Alderman Anderson, Alderman Armbrust, Alderman Bacon, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, Alderman Turner, and Alderman Wilmert), zero nays, and none absent; motion carried.  Mr. Bates said I presume everyone involved understands that we get cash or cashier’s checks before we give them any title.  Alderman Busby said yes I should have put that in my motion.

Alderman Busby said I move to take this off the table and Alderman Neitzel seconded it.  City Clerk Mrs. Martinek called the roll call.  There were ten yeas (Alderman Anderson, Alderman Armbrust, Alderman Bacon, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, Alderman Turner, and Alderman Wilmert), zero nays, and none absent; motion carried.  Alderman Busby said I move to remove from the agenda the waiving of the bidding requirements and purchase the replacement bar screen from E. Mayor Snyder said just in the way of announcements I asked Mr. Bates if he could give a quick update on the fast track demolition process that we have initiated and where we are with that. 

 

Mr. Bates said the two properties in question are 417 N. Madison Street and 718 S. College Street.  Mr. Last posted those with the necessary two foot by two foot sign I believe last Friday.  My office has now issued the necessary notices to remediate that have been mailed by certified mail return receipt requested to all properties owners of record and lien holders.  Those notices went out on Friday and today.  The notice to remediate that has to be recorded in the Logan County Recorder’s office for both properties was recorded today.  The notice to remediate that has to be published in the local newspaper for three consecutive nights is in the hands of the local newspaper and as soon as it is published the request has been made to publish as soon as possible I anticipate this week.

Mr. Bates said I believe the date of which we will be able to demolish the property will be 30 days after the third night of publication if all goes according to Hoyle and all three publications get in this week we should be in a position 30 days after this week to tear them down if nobody petitions to stop us.    

 

Mayor Snyder said any questions just wanted to bring everyone up to date on that.  Also by way of announcement don’t forget our next workshop meeting next Tuesday, October 27 is at Adams School hosted by Alderman Neitzel and Alderman Hoinacki and we are expecting the same great treatment that we received from Ward 3.  At 6:15 that night of the 27th we will have a meeting of the Sewer Committee to discuss the amnesty program. 

 

Alderman Horn said I would like to say that Ward 2 will have the Postville Courthouse meeting on November 10.

 

Mayor Snyder asked if there were anymore announcements. 

 

Alderman Busby made a motion to adjourn and Alderman Anderson seconded it.  There were ten yeas (Alderman Anderson, Alderman Armbrust, Alderman Bacon, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, Alderman Turner, and Alderman Wilmert), zero nays, and none absent; motion carried. 

 

The City Council Meeting was adjourned at 8:05 p.m.
