Minutes of a regular City Council Meeting held in the Council Chambers of City Hall, Lincoln,

IL, on Monday, June 20, 2011.

 

Mayor Snyder called the regular City Council Meeting to order at 7:00 p.m. City Clerk Mrs.

Martinek called the roll. There were nine Aldermen present (Alderman Anderson, Alderman

Armbrust, Alderman Bacon, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman

Neitzel, Alderman Tibbs, and Alderman Wilmert) and one absent (Alderman O’Donohue). Also

present were Fire Chief Miller, City Engineer Mr. Mathon, EMC Manager Mr. Tackett, Safety

Building and Zoning Officer Mr. Lebegue, and Police Chief Greenslate. Also present were City

Treasurer Mr. Conzo, City Clerk Mrs. Martinek, Mayor Snyder, City Attorney Mr. Bates, and

Recording Secretary Mrs. Riggs.

 

Those present recited the Pledge of Allegiance led by Mayor Snyder.

 

Public Participation:

 

Mayor Snyder said they would have to come back to the Public Participation for Main Street

Lincoln. There was a note from Marcia Cook on the Home Safety Event held on Saturday that

Mayor Snyder read.

 

Mayor Snyder called for the Consent Agenda:

 

Approve minutes of the April 26, 2011, the May 10, 2011, the May 24, 2011 Committee as a

Whole meetings and the June 6, 2011 Regular City Council meeting

Payment of bills

Petition by First Presbyterian Church to have the 300 block of Pekin Street one way going east

on Wednesday, July 20, 2011 between 4:00 – 7:00 p.m.

Petition by Lincoln Park District for certain streets closings on Monday, July 4, 2011 from 8:30

a.m. to 11:00 a.m. for the 6th Annual Old Fashioned Children’s Walking parade

 

Alderman Anderson moved to approve the Consent Agenda as presented and Alderman Horn

seconded it. Mayor Snyder asked if there was any discussion. City Clerk Mrs. Martinek called

the roll call. There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Bacon,

Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and

Alderman Wilmert), zero nays, and one absent (Alderman O’Donohue); motion carried.

 

Approval of any items removed from the Consent Agenda

There were no items removed from the Consent Agenda.

 

Public Participation:

 

Wanda Rohlfs of Main Street Lincoln had a handout for everyone and gave an update of what is

going on with Main Street Lincoln.

Petitions

 

Petition by Violet Robinson to construct a sidewalk at 724 Tremont Street

 

Alderman Armbrust moved to approve the petition by Violet Robinson at 724 Tremont Street

to construct a 4 ft 6 inches by 11 ft sidewalk final dimensions to be at the discretion of the

Street Superintendent and the work to be done by and at the expense of the city and Alderman

Anderson seconded it. Mayor Snyder asked if there was any discussion on this. Alderman

Armbrust said he thought they were informed by Street Superintendent Mr. Jackson this job

will entail somewhat more than 11 foot of sidewalk and would say the lady asked for what was

needed to fill the hole however this is like putting a flagpole on a condemned building if we

don’t do a little more work and he didn’t have the exact footage but thought it was a half a block

between her house and a couple in her neighborhood that are a disaster area.. Mayor Snyder said

any more discussion there is a section of sidewalk that is missing completely and then the rest

of the sidewalk and the rest of the block is pretty broken and cracked up and it will be more than

what is requested in the petition. City Clerk Mrs. Martinek called the roll call. There were nine

yeas (Alderman Anderson, Alderman Armbrust, Alderman Bacon, Alderman Busby, Alderman

Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero

nays, and one absent (Alderman O’Donohue); motion carried.

 

Mrs. Rohlfs thanked Mr. Jackson and his men for putting up the baskets around the square and

all that he did.

 

Ordinances and Resolutions

There were no Ordinances and Resolution to come before the City Council.

 

Reports

City Treasurer Mr. Conzo gave an oral report for May 2011.

 

City Clerk’s Report for May 2011 is on file.

 

Written Reports by Department heads for May 2011 are on file.

 

Bids:

 

Award bid for Sewerage Plant Backhoe

 

Alderman Busby asked Mr. Tackett what the cost of the backhoe was. Mr. Tackett said the bid

came in at $89,900 for a total price with a trade in price on the existing backhoe of $23,000.00

which would leave $66,900.00.

Mr. Tackett said if, as they discussed Thursday that if they take the backhoe they have presently

and put it at the landfill and trade the Case in then the bid price is still $89,900.00 but they have

offered $11,200.00 for the Case which would be $78,700.00.

 

Mayor Snyder asked if everyone understood that and asked if they could explain that.

 

Alderman Neitzel said they obtained a bid for the backhoe and the street department has a

backhoe at the landfill. We thought about and this is our motion that we replace that with the

one that is at the Sewerage Treatment Plant and is in better condition and take the one from the

landfill and trade it in on the backhoe. It is less of a backhoe and is less of a trade in but it will

also benefit the landfill.

 

Alderman Armbrust said do we have to or did we give these other bidders an option.

 

Mr. Tackett said the one thing we found out that the John Deere bid was actually lower than

the state bid. None of the Case or Volvo are bidding right now or JCV are not bidding against

John Deere because the manufacturer price of this machine was $157,000.00 and their bid is

$89,900.00 which is almost half price. What took place last Thursday was that Alderman Busby

and Alderman Neitzel came out and we went through this. In talking with Mr. Bates because

there were no other bids, and please correct me if I am wrong Mr. Bates, because there are no

other bids the bid can be changed with the Case rather than the John Deere with 2/3rds vote of

the Council.

 

Mr. Bates said they talked about it before the meeting and he didn’t know anything about this

until he walked in tonight and he didn’t think it was a good idea to change their bid specs and

didn’t think they should ever do it and that is exactly what you are doing. You bid to trade in a

particular tractor and have since changed it. He didn’t know if the other bidders might have a

particular use for the backhoe that is out there at the landfill and might make a better offer than

what is being offered here and we don’t know because that is not what was bid. He thought

the most correct thing to do would be to rebid but you also have the option to purchase things

without anything if you have 2/3rds vote by the City Council. What I told Mr. Tackett was they

could go through the process of not bidding and buy the one as proposed by the John Deere

dealer if that is what you choose to do. He thought if they did that the motion needs to say that

you are waiving the bidding process with respect to that vote.

 

Alderman Busby said last Thursday we also had Tracy Jackson and Russell Wright out there.

They were very happy to get the sewer department’s backhoe and trade the other one in. They

just spent $4,000.00 on theirs and this is the fourth time they have had to do it. He thought this

was the right way to go.

Award bid for Sewerage Plant Backhoe

 

Mr. Bates said he was not questioning whether it’s a benefit or not but questioning you are

bidding one way and doing something else. Alderman Neitzel said she understood that and

they also said the old one was worth $7,000.00 and they gave us a trade in of $11,000.00 so she

thought that better than they anticipated. Alderman Busby said he understood where Mr. Bates

was coming from and they only had one bid anyway.

 

Mr. Bates asked how they handled the payment of something like this. He said before it was

going to come out of sewerage and it was a trade in from sewerage department to the sewerage

department and now you are inter dispersing with street and alley department and sewerage.

 

Alderman Anderson said it was going to come out of the contingency and depreciation which

it is meant to replace equipment so that money has historically has come out of the sewerage

department because they would be purchasing the new for the sewerage department that is where

it would come out of.

 

Mr. Bates said then you taking $11,500.00 more out of that than it would have been previously.

Would that have to come out of the street department? It is $11,500.00 more than it would have

been.

 

Mr. Tackett said it is $78,700.00 total. Mayor Snyder asked if there was an amount budgeted

for that this year. Mr. Tackett said yes sir we had $55,000.00 in the collection system and then

had $40,000.00 in the plant because it is used in both entities (wastewater plant and collection

system). Mayor Snyder said so there was $95,000.00 in the budget.

 

Alderman Anderson said part of the street and alley combined budget there is a section that falls

under Mr. Jackson’s supervision that actually comes under the sewerage department and you are

getting into a bit of gray area. There is some overlap of the two departments in the budget.

 

Mr. Bates said he guessed the point he was trying to make was that as bid it would be $69,000.00

coming out of the sewer funds. Now under this new proposal you are talking about spending

$78,700.00 so you are spending approximately $10,000.00 more than you had planned to spend

out of the sewer according to what you have bid so does it all come out of the sewer or does the

$10,000.00 come out of street and alley.

 

Alderman Anderson said the way it is budgeted right now it would all come out of sewer. Mayor

Snyder said if there are no other questions he believed they had a choice of motions here. One

motion would be to reject the bids and rebid with a new trade in specifications. The other would

be to approve this bid but include in the motion the waiving of the bidding process because of the

alteration. Mr. Bates asked if the bid also included a cash price. Alderman Busby and Alderman

Neitzel said yes. Mr. Bates said that was the $89,900.00 that probably eases my concern a little

bit if you accept the cash bid price and trade in other than something that was originally planned.

Award bid for Sewerage Plant Backhoe

 

Mr. Bates said you are actually accepting the cash price $89,900.00 as opposed to the trade in

proposal that was bid and specked. Alderman Busby said we had a cash price, a trade in and a

lease price. Mr. Bates said if you accept the cash price and the motion moves to trade something

different than originally anticipated I think you are still ok.

 

Alderman Busby moved to purchase the backhoe for the sewer department in the amount of

$89,900.00 with a trade in of $11,200.00 making a total $78,700.00 and Alderman Neitzel

seconded it. City Clerk Mrs. Martinek called the roll call. There were nine yeas (Alderman

Anderson, Alderman Armbrust, Alderman Bacon, Alderman Busby, Alderman Hoinacki,

Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and

one absent (Alderman O’Donohue); motion carried.

 

Unfinished Business:

There was no Unfinished Business to come before the City Council.

 

New Business/Communications:

 

Reimbursement by the Logan County Fair Association to the Fire Department

 

Mayor Snyder said there was a request by the Logan County Fair Association for a city fire truck

and two firemen per event (2 nights at tractor pull & 1 night for demolition derby).

 

Alderman Horn said the fire chief has written a letter to the Fair Association and asked Fire

Chief Miller if they had heard anything from them. Fire Chief Miller said he had not sent that

letter yet and was waiting for tonight’s meeting. Alderman Horn said he has calculated the total

as $1,005.00 ($375.00 for engine 5104 for three nights of service @$125.00 per night and two

firefighters for 18 hours @$35.00 per hour per firefighter which is $630.00). Mayor Snyder said

he is waiting on Council approval and then he will send it on. Alderman Horn made a motion

to approve his letter to the Fair Association in the amount of $1,005.00 for the reimbursement of

the men and equipment requested at the fair and Alderman Busby seconded it. Mayor Snyder

asked if there was any discussion on this. Martinek called the roll call. There were nine yeas

(Alderman Anderson, Alderman Armbrust, Alderman Bacon, Alderman Busby, Alderman

Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Tibbs, and Alderman Wilmert), zero

nays, and one absent (Alderman O’Donohue); motion carried.

 

Recognition of the end of the probationary period for Firefighter Ashley Williams

 

Fire Chief Miller said they wanted to let everyone know that they did swear in firefighter Ashley

Williams a year for his probation period and he has met that and he wanted to recognize him. He

passed the probation with flying colors and is assigned to C shift and is working out very well for

them.

Recognition of the end of the probationary period for Firefighter Ashley Williams

 

Mayor Snyder said that they had swore firefighter Williams in as a probationary firefighter so

when they have the opportunity they should probably swear him in as firefighter.

 

Release of City FAQ’s to the City Website

 

Mayor Snyder said he asked the department heads about some questions that they frequently

get asked. They thought they would release a set of these each month at the second voting

meeting of the month and they will release and they will then be posted on the website. The

departments can refer to them if they get similar questions. This month’s questions were can

people have wiener roasts or recreational fires (fire department), swimming pool in backyard and

building permits for those (zoning office), what to do if you get pulled over by the police (police

department), and blowing grass into streets with blowers (street department).

 

Public Announcements

 

Police Chief Greenslate said the police department had recently conducted and completed is

portion of the IDOT seatbelt enforcement program commonly known as Click it or Ticket and

from May 15 to May 30 they wrote 91 seatbelt citations.

 

Mayor Snyder said Alderman Tibbs mentioned to him before the meeting about the Allen Chapel

here in town has gotten a grant to do some work and that is a good thing.

 

Mayor Snyder said tomorrow is Alderman Busby and City Treasurer Mr. Conzo are celebrating

another year of life tomorrow.

 

Alderman Busby moved to adjourn the meeting and Alderman Neitzel seconded it. City Clerk

Mrs. Martinek called the roll call. There were nine yeas (Alderman Anderson, Alderman

Armbrust, Alderman Bacon, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman

Neitzel, Alderman Tibbs, and Alderman Wilmert), zero nays, and one absent (Alderman

O’Donohue); motion carried.

 

The City Council Meeting was adjourned at 7:46 p.m.
