Minutes of a regular City Council Meeting held in the Council Chambers of City Hall, Lincoln, IL, on Monday, May 5, 2014.

 

 

 

Mayor Snyder called the regular City Council Meeting to order at 7:00 p.m. 

 

 

 

City Clerk Mrs. Gehlbach called the roll.  There were six Aldermen present (Alderman Bauer, Alderman Cooper, Alderman Horn, Alderman Neitzel, Alderman O’Donohue, and Alderman Tibbs) and two absent (Alderman Anderson and Alderman Hoinacki). Also present were Fire Chief Miller, Street & Alley Superintendent Mr. Landers, Safety and Building Officer Mr. Lebegue, and Deputy Police Chief Geriets.  Also present were Mayor Snyder, City Treasurer Mr. Conzo, City Attorney Mr. Bates, City Clerk Mrs. Gehlbach, and Recording Secretary Mrs. Riggs.

 

 

 

Mayor Snyder led The Pledge of Allegiance. 

 

 

 

Recognition of former Alderman Bruce Carmitchel :

 

 

 

Mayor Snyder thanked former Alderman Bruce Carmitchel for his service to the City of Lincoln.  Alderman Neitzel and Alderman Horn each thanked Mr. Carmitchel. Mayor Snyder presented Mr. Carmitchel with a plaque.  Mr. Carmitchel thanked the Council and said being an Alderman was harder than he thought it would be.

Approve minutes of the April 15, 2014 Public Hearing and April 15, 2013 Regular Committee of a Whole Meeting

 

Approval of fast track demolition of property at 1622 Broadway Street from Jim Moody Excavation in the amount of $4,600.00

 

 

 

Alderman Horn moved to approve the Consent Agenda as read and Alderman Tibbs seconded it. City Clerk Mrs. Gehlbach called the roll call.  There were six yeas (Alderman Bauer, Alderman Cooper, Alderman Horn, Alderman Neitzel, Alderman O'Donohue, and Alderman Tibbs) zero nays, and two absent (Alderman Anderson and Alderman Hoinacki); motion carried.

 

 

 

Ordinances and Resolutions

 

Ordinance adding a special use in the R-1 District and clarifying special uses in R-1, R-2, C-1and C-2 in the City

 

 

 

Alderman Bauer moved to approve and Alderman O’Donohue seconded it. City Clerk Mrs. Gehlbach called the roll call.  There were four yeas (Alderman Bauer, Alderman Cooper, Alderman Horn, and Alderman O'Donohue) two nays (Alderman Neitzel and Alderman Tibbs), and two absent (Alderman Anderson and Alderman Hoinacki); not having a 2/3rd majority the motion failed.

 

 

 

 

 

Ordinance #2014-806 Amending City Code, 2-3-4 pertaining to the compensation of the Fire and Police Commissioners

 

 

 

Alderman Bauer moved to approve and Alderman Cooper seconded it. City Clerk Mrs. Gehlbach called the roll call.  There were six yeas (Alderman Bauer, Alderman Cooper, Alderman Horn, Alderman Neitzel, Alderman O'Donohue, and Alderman Tibbs) zero nays, and two absent (Alderman Anderson and Alderman Hoinacki); motion carried.

 

 

 

Ordinance #2014-807 authorizing the sale of excess City personal property

 

 

 

Alderman Neitzel moved to approve and Alderman Horn seconded it. City Clerk Mrs. Gehlbach called the roll call.  There were six yeas (Alderman Bauer, Alderman Cooper, Alderman Horn, Alderman Neitzel, Alderman O'Donohue, and Alderman Tibbs) zero nays, and two absent (Alderman Anderson and Alderman Hoinacki); motion carried.

 

 

 

Resolution to resend the waiver of the City’s extraterritorial jurisdiction rights to review any subdivision within one and one-half miles outside the corporate limits

 

 

 

Alderman Horn moved to remove from the agenda and Alderman Bauer seconded it. City Clerk Mrs. Gehlbach called the roll call.  There were six yeas (Alderman Bauer, Alderman Cooper, Alderman Horn, Alderman Neitzel, Alderman O'Donohue, and Alderman Tibbs) zero nays, and two absent (Alderman Anderson and Alderman Hoinacki); motion carried.

Approve the engagement of Illinois Community Choice Aggregation Network (ICCAN)as the consultant handling the City’s electric aggregation program as part of the Logan County group for this energy contract cycle

 

 

 

Alderman Neitzel moved to approve and Alderman Horn seconded it. City Clerk Mrs. Gehlbach called the roll call.  There were six yeas (Alderman Bauer, Alderman Cooper, Alderman Horn, Alderman Neitzel, Alderman O'Donohue, and Alderman Tibbs) zero nays, and two absent (Alderman Anderson and Alderman Hoinacki); motion carried.

 

 

 

 

 

 

 

Approval of intergovernmental agreement with IDOT for acquisition of the Depot

 

 

 

Alderman Tibbs moved to approve and Alderman Bauer seconded it. City Clerk Mrs. Gehlbach called the roll call.  There were six yeas (Alderman Bauer, Alderman Cooper, Alderman Horn, Alderman Neitzel, Alderman O'Donohue, and Alderman Tibbs) zero nays, and two absent (Alderman Anderson and Alderman Hoinacki); motion carried.

 

 

 

Approval of proposal to retain Edward J. Schoenbaum as a Code Hearing Officer

 

 

 

Alderman Tibbs moved to table there being no second the motion died.  Alderman O’Donohue moved to approve and Alderman Cooper seconded it. City Clerk Mrs. Gehlbach called the roll call.  There were four yeas (Alderman Bauer, Alderman Cooper, Alderman Neitzel, and Alderman O'Donohue) two nays (Alderman Horn and Alderman Tibbs), and two absent (Alderman Anderson and Alderman Hoinacki); motion carried.

 

 

 

Approval of Agreement with Woods and Bates for legal services contract

Approval of supplement contract with Hanson Professional Services for engineering services for the Fifth Street Road Project in the amount of $36,935.00

 

 

 

Alderman O’Donohue moved to approve and Alderman Horn seconded it. Advice and Consent to mayoral appointment of Department Heads

 

 

 

Alderman Tibbs moved to approve all four Department Head appointments of 1) Ken Greenslate as Police Chief; 2) Mark Miller as Fire Chief; 3) John Lebegue as Safety and Building Officer; and 4) Walt Landers as Street Superintendent and Alderman Cooper seconded it.  City Clerk Mrs. Gehlbach called the roll call.  There were six yeas (Alderman Bauer, Alderman Cooper, Alderman Horn, Alderman Neitzel, Alderman O'Donohue, and Alderman Tibbs) zero nays, and two absent (Alderman Anderson and Alderman Hoinacki); motion carried.

 

 

 

City Attorney Mr. Bates swore in Fire Chief Miller, Street Superintendent Mr. Landers and Safety and Building Officer Mr. Lebegue.

Alderman Tibbs moved to approve and Alderman Horn seconded it.  City Clerk Mrs. Gehlbach called the roll call.  There were six yeas (Alderman Bauer, Alderman Cooper, Alderman Horn, Alderman Neitzel, Alderman O'Donohue, and Alderman Tibbs) zero nays, and two absent (Alderman Anderson and Alderman Hoinacki); motion carried.

 

 

 

Announcements:

 

 

 

Alderman Bauer had a “Visitors mean jobs” static cling for windows, cars and businesses that can be picked up at the Chamber. 

 

 

 

Mayor Snyder mentioned everyone had a post card for the 2nd Annual High School Exhibit being hosted by Lincoln Art Institute at their desks.

 

 

 

Fire Chief Miller said the fire department will be getting the fire hoses tested for their annual certification. 

 

 

 

Alderman Horn moved to go into Executive Session under 5 ILCS 120/2(c)(1) personnel and 5 ILCS 120/2(c)(21) review executive session minutes and Alderman Tibbs seconded it.  City Clerk Mrs. Gehlbach called the roll call.  There were six yeas (Alderman Bauer, Alderman Cooper, Alderman Horn, Alderman Neitzel, Alderman O'Donohue, and Alderman Tibbs) zero nays, and two absent (Alderman Anderson and Alderman Hoinacki); motion carried.  The meeting adjourned to Executive Session at 7:50 p.m. 

 

 

 

The meeting returned to regular Session at 8:16 p.m. 

 

 

 

City Clerk Mrs. Gehlbach called the roll.  There were six Aldermen present (Alderman Bauer, Alderman Cooper, Alderman Horn, Alderman Neitzel, Alderman O’Donohue, and Alderman Tibbs) and two absent (Alderman Anderson and Alderman Hoinacki).  Also present were Mayor Snyder, City Treasurer Mr. Conzo, City Attorney Mr. Blinn Bates, City Clerk Mrs. Gehlbach, City Administrator Ms. McLaughlin, and Recording Secretary Mrs. Riggs. 

 

 

 

Approval of release of executive session minutes for specific meetings

 

Alderman Tom O’Donohue moved not to release Executive Session minutes due to confidentiality and Alderman Bauer seconded it. Clerk Mrs. Gehlbach called the roll call.  There were six yeas (Alderman Bauer, Alderman Cooper, Alderman Horn, Alderman Neitzel, Alderman O'Donohue, and Alderman Tibbs) zero nays, and two absent (Alderman Anderson and Alderman Hoinacki); motion carried. 

 

 

 

Alderman Neitzel moved to adjourn the meeting and Alderman Tibbs seconded it. There were six yeas (Alderman Bauer, Alderman Cooper, Alderman Horn, Alderman Neitzel, Alderman O'Donohue, and Alderman Tibbs) zero nays, and two absent (Alderman Anderson and Alderman Hoinacki); motion carried.

 

 

 

The City Council Meeting was adjourned at 8:16 p.m.
