Minutes of the City of Lincoln City Council Committee of the Whole Meeting held in the Council Chambers on Tuesday, November 12, 2013. 

 

 

 

Those present were Alderman Anderson, Alderman Carmitchel, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman O'Donohue, Alderman Tibbs, and Alderman Wilmert.  Also present were Assistant Street Superintendent Mr. Wright, Safety and Building Officer Mr. Lebegue, Fire Chief Miller, American Water/EMC Mgr. Mr. Ferguson, and Police Chief Greenslate.  Also present were Mayor Snyder, City Clerk Mrs. Gehlbach, City Attorney Mr. Blinn Bates, City Treasurer Mr. Conzo, City Administrator Ms. McLaughlin, and Recording Secretary Mrs. Riggs.  

 

 

 

Mayor Snyder called the meeting to order at 7:07 p.m.  There were eight Aldermen present (Alderman Anderson, Alderman Carmitchel, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman O'Donohue, Alderman Tibbs and Alderman Wilmert) and none absent.

 

 

 

Public Participation:

 

There was no public participation.

 

 

 

Long Term Control Plan (LTCP) Engineering:

 

Ms. McLaughlin quickly reviewed what the EPA is requiring to be addressed by the long term control plan by the City of Lincoln. 

 

 

 

Mr. Ferguson handed out a sheet with firms that can do the long term control plan.  There were eight firms who responded and the engineering firm of Crawford, Tilly & Murphy had the best qualifications as well as recommendations.  The plan has to be submitted by April 30, 2015.  The sewer rates may have to be adjusted to cover the cost of the long term control plan.  There will be an implementation plan at the end of this process.  This firm has had successful plans that have been approved by the EPA.

 

 

 

Hotel/Motel Tax Penalty:

 

Ms. McLaughlin said the City will begin collecting the hotel/motel tax beginning January, 2014 for December, 2013.  A recommendation of a 2% penalty will given to any hotel or motel who does not pay on time.  This will be on the agenda for November 18, 2013. 

 

 

 

Hamilton Street Whitetopping Pay Request #1:

 

Mr. Forgy said Maurer Stutz gave the city a pay estimate.  Mr. Forgy recommended this payment, which was under the awarded budget amount.  This item will be on the Consent Agenda for November 18, 2013. 

 

 

 

Loud, Disturbing Unnecessary Noise Ordinance:

 

Ms. McLaughlin requested the Loud, Disturbing Unnecessary Noise Ordinance which will make it more enforceable. This will set parameters for time limits which the current ordinance did not have.

 

 

 

Alderman Wilmert was concerned about telling businesses they could not have loud music.  Ms. McLaughlin said some of the bars during the summer open their doors and the noise is louder than it should be.  Alderman Anderson said it is not exclusive to what is listed and wondered if they were going to have to go over the Speedway again.  Police Chief Greenslate said there are three layers to the list and the Speedway would not be an issue.

Other Discussion:

 

Alderman Carmitchel mentioned that the racetrack is the one thing he gets the most complaints about.  Ms. McLaughlin said the speedway brings people to Lincoln, they are staying at the hotels/motels and dining in our Lincoln's restaurants which generates money for the City.  Alderman Wilmert said a survey given to the race goers might give them a figure.

Alderman Anderson moved to go into Executive Session pursuant to 5 ILCS 120/2(c)(11) probable or possible or imminent litigation and Alderman Horn seconded it.  City Clerk Mrs. Gehlbach called the roll call.  There were eight yeas (Alderman Anderson, Alderman Carmitchel, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman O'Donohue, Alderman Tibbs, and Alderman Wilmert), zero nays, and none absent; motion carried. The meeting adjourned to Executive Session at 7:53 p.m. 

 

 

 

The meeting returned to regular Session at 8:43 p.m.  City Clerk Mrs. Gehlbach called the roll.  There were eight Aldermen present (Alderman Anderson, Alderman Carmitchel, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman O’Donohue, Alderman Tibbs, and Alderman Wilmert) and none absent. Police Chief Greenslate was also present.  Also present were Mayor Snyder, City Treasurer Mr. Conzo, City Attorney Mr. Blinn Bates, City Clerk Mrs. Gehlbach, City Administrator Ms. McLaughlin, and Recording Secretary Mrs. Riggs. 

 

 

 

Alderman Neitzel made a motion to adjourn the meeting and Alderman Tibbs seconded it.  There were eight yeas (Alderman Anderson, Alderman Carmitchel, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman O'Donohue, Alderman Tibbs, and Alderman Wilmert), zero nays, and none absent; motion carried. 

 

 

 

The City of Lincoln Committee of the Whole Meeting adjourned at 8:45 p.m.
