Minutes of a regular City Council Meeting held in the Council Chambers of City Hall, Lincoln, IL, on Monday, May 19, 2008.

 

Mayor Davis-Kavelman called the regular City Council Meeting to order at 7:18 p.m.  City Clerk Ms. Riggs called the roll.  There were ten Aldermen present (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Neitzel, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs) and none absent.   Also present were Department Heads Assistant Fire Chief Miller, Police Chief Erlenbush, Safety and Building Officer Mr. Last, City Engineer Mr. Mathon, EMC Manager Mr. Kitzmiller, and Street and Alley Superintendent Mr. Jackson.  Also present were City Treasurer Mr. Plotner, City Clerk Ms. Riggs, Mayor Davis-Kavelman, and City Attorney Mr. Bates. 

 

Those present recited the Pledge of Allegiance to the Flag led by Alderman Hoinacki.

 

Appointment for Police Chief

 

Mayor Davis-Kavelman said two weeks ago we began our first meeting with the new fiscal year and as it was our City Police Chief who I’d like to re-nominate again for another year was not present so I will.  We’ve already approved your nomination and you missed out on a very nice speech I had about you but anyway he’s done a wonderful job in this past year and I do appreciate him as well as all our other department heads so we will have you come in and be sworn in right now. 

 

City Attorney Mr. Bates swore in Police Chief Erlenbush.

 

Appointment of Fire Chief

 

Mayor Davis-Kavelman said our next appointment is the one that we’ve been waiting for awhile on this and I wanted to say a few things before we get to this one.  Operating under the directives of our City Council and we always operate I’ve always thought as a round table discussion and we go into Executive Session and talk about things that we’d like to improve and we cannot talk about out in public and one of those we never want to embarrass a candidate.  We’ve gone through a lot of work on this position of Fire Chief.  Our fire chief, our former fire chief retired but was not off the books until December 31, 2007.  At that point since we already had three assistant chiefs operating each shift on 24 and off 48 they were called in and Alderman Anderson who was the fire chair at the time and I do thank you very much for all your help on all this.  She and I talked about this and when we told them to just to continue on operating their shift just as if the chief was still there to go ahead and do their work and so we saw what they were made of and in the meantime, they’ve done a very good job so thank you Assistant Chief Milo’s here too so thank you very much Mr. Miller but we were told through our discussion and we came up with an idea that we should probably go outside as well as allow anyone internally who wanted to apply for the Fire Chief position.

Appointment of Fire Chief

 

Mayor Davis-Kavelman said we did send out a nationwide advertisement and we did get applications from both the East and West coasts and Alderman Anderson helped me go down the line and we proceeded from there.  At this time after discussion and working through everything we could background check and everything at this time it is my pleasure that I would like to ask for the nomination of Mr. Kent Allan Hulett.  He’s from Rockford, Illinois, he’s got a very strong background in fire science fire service and I’d like to ask for his endorsement for Fire Chief. 

 

Alderman Prather said I move to approve your nomination and Alderman Anderson seconded it. 

 

Mayor Davis-Kavelman asked if there was any discussion regarding this individual.  She said Mr. Hulett will you come forward please I’d like for them to see who you are so the people in the community can see who we are bringing forward.  Come stand at the podium for just a moment.  Is there anything else I spent a lot of sleepless nights I know that Alderman Anderson did too we were trying to find who would be a very good candidate for our community.  Sometimes its good and I’ve always believed hiring from within promoting from within but this was a directive that they wanted to open up for everyone to have a chance to apply so this is our best candidate and I would like to ask for his endorsement. 

 

City Clerk Ms. Riggs called the Roll Call.  There were ten yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, and none absent; motion carried.  Mayor Davis-Kavelman said we forgot to put in the motion what we were going to give as a salary so Alderman Anderson would you like to either withdraw your motion and then you go make the motion adding that in or how would you like to handle it.  Alderman Anderson said I would make the motion that the salary for the new Fire Chief position, be $55,000.00 annually and Alderman Armbrust seconded it.  Mayor Davis-Kavelman said with the standard vacation package and all that stuff.  City Clerk Ms. Riggs called the Roll Call.  There were ten yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, and none absent; motion carried. 

 

City Attorney Mr. Bates swore in Fire Chief Hulett. 

 

Fire Chief Hulett introduced his family and friends that were present with him.  Present with Fire Chief Hulett was his mother, Helen, sister, Fay, his dad, Allan (who is an old retired Fire Chief from Illinois), sitting in front of them his friend Ross (who is a retired firefighter) and back over here is Sgt. Wong who is back from a tour in Iraq and is a retired firefighter like the Mayor’s son.  Unfortunately my wife and kids couldn’t make it because I found out about an hour ago I am a grandfather of a beautiful baby girl.

Mayor Davis-Kavelman said he could sit over with the other department heads and they would help get him his uniforms and all of that tomorrow. 

 

Mayor Davis-Kavelman called for the Presentation of the Minutes:

Alderman Huskins said we haven’t received the minutes for May 5 meeting so they will be on June 2nd’s agenda.   

 

Mayor Davis-Kavelman asked for the Presentation of Petitions:

 

Petition for sidewalk at 920 N. Logan Street by Clyde Camp (work to be done by and at the expense of the city)

 

Alderman Hoinacki said I move to approve the sidewalk petition at 920 N. Logan Street by Clyde Camp (work to be done by and at the expense of the city) and Alderman Rohlfs seconded it.  City Clerk Ms. Riggs called the Roll Call. There were ten yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, and none absent; motion carried.

           

Petition for sidewalk at 916 N. Logan Street by Linda Tucket (work to be done by and at the expense of the city)

 

Alderman Hoinacki said I move to approve the sidewalk petition at 916 N. Logan Street by Linda Tucket (work to be done by and at the expense of the city) and Alderman Rohlfs seconded it.  Street Superintendent Mr. Jackson said I just want to say that both of these properties there’s adjoining properties next to them also that have bad sections and they will be replaced at the same time.  City Clerk Ms. Riggs called the Roll Call. There were ten yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, and none absent; motion carried.

 

Petition for sidewalk at 627 Lincoln Avenue (Kankakee Street side) by Steve Ownes (work to be done by and at the expense of the city)

 

Alderman Hoinacki said I move to approve the sidewalk petition for 627 Lincoln Avenue which is the Kankakee Street side of that property (work to be done by and at the expense of the city) and Alderman Rohlfs seconded it.  Alderman Busby said Mr. Jackson does that whole sidewalk have to be repaired.  Mr. Jackson said approximately 20 foot where a tree root has heaved up the sections of walk right there by their fence.  Alderman Busby said it should be added in the motion then that.  Mr. Bates said I think all the petitions say at the discretion of the Street Superintendent.

Alderman Armbrust said I move to accept prove the Petition for the repair if guttering between 180 and 200 Mayfair Drive by Charles and June Fried and Alderman Tibbs seconded it.  City Clerk Ms. Riggs called the Roll Call. There were ten yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, and none absent; motion carried.

 

Petition for the use of City grounds and streets for the 2008 Lincoln Art and Balloon Fest by Bobbi Abbott, Executive Director

 

Alderman Tibbs said I move to approve the use of the city grounds and streets for the 2008 Lincoln Art and Balloon Fest submitted by Bobbi Abbott, Executive Director and Alderman Prather seconded it. Mayor Davis-Kavelman said we’re supposed to be picking out our balloon soon and I hope it’s an Abraham Lincoln theme or something.  City Clerk Ms. Riggs called the Roll Call. There were ten yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, and none absent; motion carried.

 

Mayor Davis-Kavelman asked for the Presentation of Communications:

City Clerk Ms. Riggs stated that there were no Communications to come before the City Council.

 

Mayor Davis-Kavelman asked for the Presentation of Bids:

City Clerk Ms. Riggs stated that there were no Bids to come before the City Council.

Resolution for Annual Appropriations

 

Alderman Rohlfs said I move to approve the Annual Appropriations Resolution as read on May 13, 2008 and Alderman Prather seconded it.

Proclamation for Older Americans

 

Alderman Rohlfs asked City Clerk Ms. Riggs to read the Proclamation for Older Americans.  City Clerk Ms. Riggs read the Proclamation.  Alderman Rohlfs said I move to approve the Proclamation for Older Americans and Alderman Prather seconded it.  There were ten yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, and none absent; motion carried.

 

Proclamation for Catholic Charities Month – June, 2008

 

Alderman Rohlfs asked City Clerk Ms. Riggs to read the Proclamation for Catholic Charities Month.  City Clerk Ms. Riggs read the Proclamation.  Alderman Rohlfs said I move to approve the Proclamation for Catholic Charities Month and Alderman Prather seconded it.  There were ten yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, and none absent; motion carried.

 

The Mayor then asked for the Presentation of Claims, Presentations, Reading, Reference and Reports Thereon:

 

Alderman Huskins made a motion by Roll Call to approve: Finance, Policy & Procedure, Streets & Alleys, Police, Ordinance and Zoning, Insurance, Sidewalks, Forestry, Lighting, Fire/Water & ESDA, and Grounds, Buildings & Local Improvements Committees' Reports by roll call and Alderman Horn seconded it.  City Clerk Ms. Riggs called the Roll Call. There were ten yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, and none absent; motion carried.

 

Mayor Davis-Kavelman then asked for the Presentation of Official Reports:

City Treasurer Mr. Plotner gave an Oral Report for April, 2008.

 

Mayor Davis-Kavelman asked for the Presentation of Special Reports:

The following yearly oral reports were given:  Police Chief Erlenbush, City Engineer Mr. Mathon, Assistant Fire Chief Miller, EMC Manager Mr. Kitzmiller, Street Superintendent Mr. Jackson, and City Attorney Mr. Bates.

Mayor Davis-Kavelman asked for the Presentation of Unfinished Business:

City Clerk Ms. Riggs said there was no Unfinished Business to come before the City Council.

 

Mayor Davis-Kavelman asked for the Presentation of Special Reports:

The written reports by the department heads (Operation’s Report for the Sewerage Treatment Plant for April, 2008, Police Department report for April, 2008, Street Superintendent's Report for April 2008, Engineering Report for January 2008, and Summary of Building Permits for April 2008) are on file.

 

Mayor Davis-Kavelman asked for New Business:

 

Approval of purchase of new computer for Fire Department 

 

Alderman Busby said I move for the approval to purchase a new computer for the fire department from WTI Systems Ltd. not to exceed $2,800.00 and Alderman Armbrust seconded it.  Alderman Busby said the computer they had crashed and it’s no good whatsoever but along with this is also included 4-6 hours of labor to install plus a battery backup system and a backup network storage server so that they can back everything up or with the battery in case the power goes out and they can at least shut it down and at least save the material so it includes all of this.  Alderman Busby said some of this is because it is going to be connected to all the other computers too.  Mayor Davis-Kavelman said is this WTI a local group or is this, another corporation somewhere.  Alderman Busby said it’s the one that has always worked with Ms. Riggs on the computer systems.  Ms. Riggs said it is because the fire department computers are directly tied to our city server downstairs.  Mayor Davis-Kavelman said I wanted to ask that question because we will be asked that question, thank you.  Mayor Davis-Kavelman asked if there were any other comments. 

 

Assistant Fire Chief Miller said a little more along that that computer has all our training data base on that and we were able to retrieve some of that and that’s the main use of that computer.  I was talking to Alderman Busby earlier and went to a seminar this last weekend and received a laptop for our reporting systems which is what we use in the inspectors office and the state has given us a computer for our national reporting and it has some stipulations and I need to talk to the chief and probably some committee people about the use of that.  If we don’t want to use that because of some of the state stipulations we can give that back but we did receive other information things for helping us with our reporting so computer wise we may be able to add another one to help us out there.

Approval of the use of Police Funds for the purchase of four breath instruments with mouthpieces for the Police Department at a cost of $1,853.50

 

Alderman Horn said I move to approve use of Police Funds for the purchase of four breath instruments with mouthpieces at the cost of $1,853.50 and Alderman Busby seconded it.  City Clerk Ms. Riggs called the Roll Call. There were ten yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, and none absent; motion carried.

 

Contract with Logan County for Animal Control

 

Alderman Anderson deferred this to Alderman Prather.  Alderman Prather said I move to approve the one year contract with Logan County for Animal Control the contract amount to be $36,050.00 this is an increase of $1,050.00 from previous year or 3% with the term of the contract to begin June 1, 2008 to end May 31, 2009 and Alderman Anderson seconded it.  City Clerk Ms. Riggs called the Roll Call. There were seven yeas (Alderman Anderson, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Neitzel, and Alderman Tibbs), three nays (Alderman Armbrust, Alderman Busby, and Alderman Rohlfs), and none absent; motion carried.

 

Approval of Temporary and Permanent Easements with Lincoln Lakes Condo Association for the construction of new force main sewer line for the South Plant Lift Station

 

Alderman Neitzel said I make a motion for the Approval of Temporary and Permanent Easements with Lincoln Lakes Condo Association for the construction of new force main sewer line for the South Plant Lift Station and Alderman Rohlfs seconded it.  Clerk Ms. Riggs called the Roll Call. There were ten yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, and none absent; motion carried.

 

Approval of electrical equipment purchase at the Sewerage Treatment plant a cost of $59,466.00 and to waive the bidding process

 

Alderman Neitzel said I make a motion for the Approval of electrical equipment purchase at the Sewerage Treatment plant at a cost of $59,466.00 and to waive the bidding process and Alderman Anderson seconded it. 

 

Alderman Neitzel said beings that we’re on the television this evening and the voters of Lincoln, some of them are watching this electrical equipment that we are purchasing for the sewerage treatment plan is to reduce the electric bill and save the city money on this electric bill.  They have given us their word if they are unable to reduce a refund that the cost of the electrical equipment will be refunded to us so we feel this is a win/win situation for the City of Lincoln.

Approval of electrical equipment purchase at the Sewerage Treatment plant a cost of $59,466.00 and to waive the bidding process

 

Alderman Huskins said do we have a name who we’re, who’s this electric equipment.  Alderman Neitzel asked what name we have on this Mr. Kitzmiller.  Mr. Kitzmiller said Total Energy Concepts.  Alderman Huskins said that was all I was wondering.  Mayor Davis-Kavelman said my question is does this company for this amount of money does this company that is exclusive for this type of work, is that what we’re talking here and is that why we’re waiving the bid.  Mr. Kitzmiller said I have been in contact with other companies and they have refused to provide this detail of equipment or provide a guarantee that the equipment will function like Total Energy Concepts has provided.  Mayor Davis-Kavelman said ok so you feel that guarantees what’s helping.  Alderman Neitzel said this is our second phase, is that not correct.  Mayor Davis-Kavelman said I know.  Mr. Kitzmiller said this is the second phase.  Clerk Ms. Riggs called the Roll Call. There were ten yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, and none absent; motion carried.

 

Approval to contribute $2,700.00 toward the replacement of a culvert on the road leading to Lincoln Lakes which is a part of a drainage System the city benefits from

 

Alderman Neitzel said I make a motion for the Approval to contribute $2,700.00 toward the replacement of a culvert on the road leading to Lincoln Lakes which is a part of a drainage System the city benefits from and Alderman Anderson seconded it.  Mr. Mathon said it did not strike me until just a little while ago could that motion read not to exceed that amount I have been working with Mr. Fleshman of the condo association trying to find different suppliers for the material that may be at a lower cost than what the initial estimate was made out at.  Alderman Neitzel said amend it and Alderman Anderson said that’s fine.  Alderman Neitzel said again I just want to say to the voters that if you stand on Home Avenue and look towards Lincoln Lakes or the Lincoln Lakes Road all that water from Home Avenue and the Odd Fellows flows down through the drainage system and down through our culvert on the Lincoln Lakes Association roadway so it is a definite benefit to the City of Lincoln for this drainage that we have this, thank you.   Clerk Ms. Riggs called the Roll Call. There were ten yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, and none absent; motion carried. 

 

Alderman Anderson said I would just like to clarify back to two items ago on the electrical equipment that is being purchased.  Some of the terminology that was used was a refund this is not a refund Mr. Kitzmiller it’s actually a savings on our expenditures of electricity is that correct.

Mr. Kitzmiller said that is correct they are guaranteeing that we will save approximately $58,000.00 a year.  If that does not happen then there will be a refund of the equipment that is correct.

 

Alderman Anderson said so they are actually hoping that we don’t get a refund.  Mr. Kitzmiller said that is correct.  Alderman Neitzel thanked Alderman Anderson and said she knew we would get some money back. 

 

Alderman Rohlfs said I would just like to remind people that next Monday is Memorial Day and there will be a celebration in the downtown and if everyone can make it I am sure all of the Veterans would appreciate you being there on Memorial Day.  It is at 10:30 a.m.

 

Alderman Prather made a motion to adjourn and Alderman Huskins seconded it.  There were ten yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, and none absent; motion carried.

 

The City Council Meeting was adjourned at 8:45 p.m.
