Minutes of a regular City Council Meeting held in the Council Chambers of City Hall, Lincoln, IL, on Monday, May 5, 2008.

 

Mayor Davis-Kavelman called the regular City Council Meeting to order at 7:20 p.m.  City Clerk Ms. Riggs called the roll.  There were nine Aldermen present (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs) and one absent (Alderman Neitzel).

 

Alderman Busby said I would like to go to Executive Session under 5 ILCS 120/2(c)(1) personnel, hiring, compensation and Alderman Prather seconded it.  City Clerk Ms. Riggs called the roll call.  There were nine yeas (Alderman Anderson, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs), zero nays, and one absent (Alderman Neitzel); motion carried.  The meeting adjourned to Executive Session at 7:21 p.m.

 

The meeting returned to regular Session at 7:39 p.m.  City Clerk Ms. Riggs called the Roll Call. There were nine Aldermen present (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs) and one absent (Alderman Neitzel).

 

Those present recited the Pledge of Allegiance to the Flag led by Alderman Anderson.

 

Mayor Davis-Kavelman handed out the following Committee assignments:  See attachment.

 

Mayor Davis-Kavelman gave the State of the City.

 

Appointment of City Attorney

 

Mayor Davis-Kavelman said that Mr. Bates has been a valuable asset to our community as far as his municipal law ability and an integral part of the administration these past 6 years.  He’s also been invaluable with the Planning Commission and the union negotiations and we are in union negotiations at this time.  It is with great pleasure that I nominate Mr. Bates as City Attorney for another year.   

 

Alderman Prather made a motion to approve Mayor Davis-Kavelman’s nomination and Alderman Anderson seconded it.  City Clerk Ms. Riggs called the Roll Call. There were nine yeas (Alderman Anderson, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs), zero nays, and one absent (Alderman Neitzel); motion carried.

Appointment of Building and Zoning Officer

 

Mayor Davis-Kavelman said at this time I wish to reappointment of Mr. Les Last as City of Lincoln Building and Zoning Officer for Fiscal Year May 1, 2008 through April 30, 2009.  Mr. Last has continued to be a positive asset to our community I know you’re the front line when things don’t go exactly the way neighbors or citizens think.  You do take a lot of that home with you I understand and very much appreciate your diligence and taking care of all of this and again it is with great pleasure that I nominate Mr. Last for another year term.

 

Alderman Prather made a motion to approve the Mayor’s nomination of Mr. Last and Alderman Huskins seconded it.  City Clerk Ms. Riggs called the Roll Call. There were nine yeas (Alderman Anderson, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs), zero nays, and one absent (Alderman Neitzel); motion carried.

 

Appointment for Street Superintendent

 

Mayor Davis-Kavelman said I wish to reappointment of Mr. Tracy Jackson as City of Lincoln Street Superintendent for Fiscal Year May 1, 2008 through April 30, 2009.  Again Mr. Jackson is our go to guy. If there is something to be done he is doing it and he is out there he’s picking up broken limbs on the streets and keeping the road conditions well.  You’ve got your staff you’ve got a small staff and you do need more staff and you’ve got them working all the time and appreciate all you do.  At this time I have great pleasure in nominating him asking for his nomination.

 

Alderman Armbrust said I move to accept the nomination of Tracy Jackson for Street Superintendent and Alderman Tibbs seconded it.  Alderman Huskins said Mayor you know I think Mr. Jackson probably does a good job you know but my phone rings all the time for the streets that hasn’t been plowed or certain things that haven’t been done so I will be voting no on Mr. Jackson.  City Clerk Ms. Riggs called the Roll Call.  There were eight yeas (Alderman Anderson, Alderman Busby, Alderman Armbrust, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs), one nay (Alderman Huskins), and one absent (Alderman Neitzel); motion carried.

 

Appointment for Police Chief

 

Mayor Davis-Kavelman said I’d like to appoint Police Chief Stuart Erlenbush.  As you know we’ve gone through a year.  We’ve had some controversy prior to that he’s come on the scene he didn’t plan on being the police chief but it just kind of fell in that way and it worked out well.  He’s done an excellent outstanding job in that capacity and he did say that he would stay on for another year so if you’d be so kind someone I’d like to reappoint Mr. Erlenbush.

Appointment for Police Chief

 

Alderman Horn said I’d like to make the motion to reappoint Mr. Erlenbush and Alderman Huskins seconded it.  City Clerk Ms. Riggs called the Roll Call. There were nine yeas (Alderman Anderson, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs), zero nays, and one absent (Alderman Neitzel); motion carried. Mayor Davis-Kavelman said thank you I understand he will be sworn in on the 19th.  City Clerk Ms. Riggs said correct.

 

Mayor Davis-Kavelman said at this point you know we thought we’d have a Fire Chief today and thought I had a candidate to bring forward to the Council and then at 12:39 p.m. today he called and said that his family had had another meeting and they felt that it was important that he stay right where he was.  He is not accepting the position so we’ve talked with our next candidate and we will be working on that and we have a little more background to do then possibly by May 19th we’ll have a candidate to approve as our new fire chief. 

 

City Clerk Ms. Riggs swore in City Attorney Mr. Bates, Street Superintendent Mr. Jackson and City Building and Safety Officer Mr. Last.

 

City Attorney Mr. Bates swore in Mr. Wheat as Liquor Commission.

 

Alderman Tibbs made a motion to nominate Alderman Neitzel as Mayor Pro Tem and Alderman Prather seconded it.  Alderman Prather said you should ask for any other nominations. City Clerk Ms. Riggs called the Roll Call. There were eight yeas (Alderman Anderson, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs), one nay (Alderman Busby), and one absent (Alderman Neitzel); motion carried.

 

Mayor Davis-Kavelman called for the Presentation of the Minutes:

Alderman Huskins made a motion to approve the Regular City Council Meeting Minutes of April 21, 2008 and Adjourned City Council Meeting of April 29, 2008 and Alderman Anderson seconded it.  There were nine yeas (Alderman Anderson, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs), zero nays, and one absent (Alderman Neitzel); motion carried.

 

Mayor Davis-Kavelman asked for the Presentation of Petitions:

 

Petition for sidewalk at 530 S. State Street by Jason DeOrnellas (work to be done by and at the expense of the city)

 

Alderman Hoinacki said I move to deny the petition for the sidewalk on 530 S. State Street and Alderman Rohlfs seconded it.  Alderman Hoinacki said this petition was denied on the fact the sidewalk that is there now is adequate brick sidewalk and looks fairly decent compared to other brick sidewalks in town so that was our reasoning.

City Clerk Ms. Riggs called the Roll Call. There were nine yeas (Alderman Anderson, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs), zero nays, and one absent (Alderman Neitzel); motion carried.

 

Petition for alley, driveway, and sidewalk repairs for Neighbors to Nations Church, at owner’s expense, by J. Anthony Snuff

 

Alderman Armbrust said I move to approve the petition for the alley, driveway, and sidewalk repairs for Neighbors to Nations Church as the owner’s expense and note that this work should be done in accordance with the city code and Alderman Tibbs seconded it.  City Clerk Ms. Riggs called the Roll Call. There were nine yeas (Alderman Anderson, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs), zero nays, and one absent (Alderman Neitzel); motion carried.

 

Mayor Davis-Kavelman asked for the Presentation of Communications:

City Clerk Ms. Riggs stated that there were no Communications to come before the City Council.

 

Mayor Davis-Kavelman asked for the Presentation of Bids:

City Clerk Ms. Riggs stated that there were no Bids to come before the City Council. 

 

The Mayor then asked for the Presentation of Ordinances and Resolutions:

 

2008 Motor Fuel Tax General Maintenance Resolution

 

Alderman Rohlfs asked City Clerk Ms. Riggs to read the Resolution.  City Clerk Ms. Riggs read the Resolution.  Alderman Rohlfs said I move to approve the said Resolution and Alderman Prather seconded it.  City Clerk Ms. Riggs called the Roll Call. There were nine yeas (Alderman Anderson, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs), zero nays, and one absent (Alderman Neitzel); motion carried.

 

Proclamation for Municipal Clerk’s Week

 

Alderman Rohlfs read the Proclamation.  Alderman Rohlfs made a motion to approve the Proclamation for Municipal Clerk’s Week and Alderman Prather seconded it.  Alderman Tibbs said I would just like to say that I wish every community could have a municipal clerk like we have and she has the answer to just about any and every question that you have.  Mayor Davis-Kavelman said she is very resourceful.  Alderman Tibbs said we appreciate her.

Proclamation for Municipal Clerk’s Week

 

Mayor Davis-Kavelman said you know sometimes the most, smoothest things work and you don’t know they’re going and she’s very smooth at getting everything done and she has a very good staff very dedicated staff. 

 

City Clerk Ms. Riggs called the Roll Call. There were nine yeas (Alderman Anderson, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs), zero nays, and one absent (Alderman Neitzel); motion carried.

 

The Mayor then asked for the Presentation of Claims, Presentations, Reading, Reference and Reports Thereon:

 

Alderman Huskins made a motion by Roll Call to approve: Finance, Policy & Procedure, Sanitation, Insurance, and Grounds, Buildings & Local Improvements Committees' Reports by roll call and Alderman Horn seconded it.  City Clerk Ms. Riggs called the Roll Call. There were nine yeas (Alderman Anderson, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs), zero nays, and one absent (Alderman Neitzel); motion carried.

 

Mayor Davis-Kavelman then asked for the Presentation of Official Reports:

City Clerk’s Report for April, 2008 was handed out tonight.

 

Mayor Davis-Kavelman asked for the Presentation of Special Reports:

Building and Zoning Officer Mr. Last gave an oral yearly report.

 

Mayor Davis-Kavelman asked for the Presentation of Unfinished Business:

Alderman Busby said I think it’s under Unfinished Business with regard to hiring a Fire Chief due to the fact that I am now chairman and Melody Anderson isn’t I would suggest that she stay in that until it is finalized.  Mayor Davis-Kavelman said you mean stay in as far as the review of it or as the chairperson.  Alderman Busby said she’s been in on it since the beginning.  Alderman Prather said continue the review.  Mayor Davis-Kavelman said as far as the chair part of it are you going to relinquish that as well until.  Alderman Busby said if you’d like me to I will.  Mayor Davis-Kavelman said I didn’t think we needed to but whatever you want to do work together on it.  Alderman Busby said let her finalize the new Fire Chief.  Mayor Davis-Kavelman asked Alderman Anderson if that was fine with her.  Alderman Anderson said that was fine. 

 

Mr. Bates said in the same vane since the outgoing chair of Police and Fire have been negotiating along with myself and my son on the collective bargaining agreements will those individuals continue or will the new chairs start.  Alderman Prather said it should continue.  Mayor Davis-Kavelman said I’d like to continue yes if you are willing to continue doing as you have been.  Alderman Horn said yes.  Mayor Davis-Kavelman said alright thank you very much.

Mayor Davis-Kavelman asked for New Business:

City Clerk Ms. Riggs said there was no New Business to come before the City Council. 

 

Alderman Huskins made a motion to adjourn and Alderman Prather seconded it.  There were nine yeas (Alderman Anderson, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Prather, Alderman Rohlfs, and Alderman Tibbs), zero nays, and one absent (Alderman Neitzel); motion carried.

 

The City Council Meeting was adjourned at 8:20 p.m.
