Minutes of a regular City Council Meeting held in the Council Chambers of City Hall, Lincoln, IL, on Monday, February 4, 2008.

 

Mayor Davis-Kavelman called the regular City Council Meeting to order at 7:15 p.m.  City Clerk Ms. Riggs called the roll.  There were nine Aldermen present (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs) and one absent (Alderman Prather).   Also present were Assistant Fire Chief Dahm, Police Chief Erlenbush, Street Superintendent Mr. Jackson, EMC Manager Mr. Kitzmiller, City Engineer Mr. Mathon, and Safety and Building Officer Mr. Last.  Also present were City Attorney Mr. Bates, City Treasurer Mr. Plotner, City Clerk Ms. Riggs and Mayor Davis-Kavelman.

 

Those present recited the Pledge of Allegiance to the Flag led by Alderman Hoinacki.

 

Alderman Horn made a motion to go into Executive Session under 5 ILCS 120/2(c)(1) to discuss personnel hiring and firing and performance and Alderman Rohlfs seconded it.  City Clerk Ms. Riggs called the Roll.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, one absent (Alderman Prather); motion carried.  The meeting adjourned to Executive Session at 7:16 p.m.

 

The meeting returned to regular Session at 7:45.  City Clerk Ms. Riggs called the Roll.  There were nine Aldermen present (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs) and one absent (Alderman Prather).

 

Mayor Davis-Kavelman called for the Presentation of the Minutes:

Alderman Anderson said the minutes of the Regular City Council Meeting on January 22, 2008 have not been completed at this time and will be ready for review and approval at the next voting session. 

 

Mayor Davis-Kavelman asked for the Presentation of Petitions:

 

Petition for the use of Postville Park for the Route 66 Garage Sale on June 13 and 14, 2008 by Bruce Huskins, Project Manager

 

Alderman Tibbs said I move to approve this petition for the use of the Postville Park for the Route 66 Garage Sale contingent to their proof of insurance and Alderman Armbrust seconded it.  Mayor Davis-Kavelman said do we have a date when this is going to incur.  Alderman Tibbs said the date is June 13 and 14, 2008 it is on a Friday and Saturday this year and it's their second year or the 66 Garage Sale.  Alderman Huskins said this is my brother and I don't feel this is a conflict of interest but I'd like to ask the council, is that true.  Mr. Bates said what is your question I have no idea what you just said.

Petition for the use of Postville Park for the Route 66 Garage Sale on June 13 and 14, 2008 by Bruce Huskins, Project Manager

 

Alderman Huskins said this pertains to my brother for his petition and I feel this is no conflict for me to vote, is that true.  Mr. Bates said I agree.  City Clerk Ms. Riggs called the roll.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, one absent (Alderman Prather); motion carried. 

 

Mayor Davis-Kavelman asked for the Presentation of Communications:

City Clerk Ms. Riggs said there were no Communications to come before the City Council.

 

Mayor Davis-Kavelman asked for the Presentation of Bids:

City Clerk Ms. Riggs said there were no Bids to come before the City Council. 

 

The Mayor then asked for the Presentation of Ordinances and Resolutions:

 

Truancy Ordinance tabled on December 3, 2007

 

Alderman Rohlfs said I move to take the Truancy Ordinance off the table and Alderman Neitzel seconded it.  City Clerk Ms. Riggs called the roll.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, one absent (Alderman Prather); motion carried.  Alderman Rohlfs said I would like to turn this over to Alderman Neitzel.  Alderman Neitzel said thank would the City Clerk please read the Committee's Report.  City Clerk Ms. Riggs read the Ordinance.  Alderman Neitzel made a motion to accept the Committee's Report and Alderman Rohlfs seconded it.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, one absent (Alderman Prather); motion carried.  Alderman Neitzel asked City Clerk Ms. Riggs to read the Truancy Ordinance.  City Clerk Ms. Riggs read the Truancy Ordinance.  Alderman Neitzel said Ms. Riggs under Section D or a truancy case worker from any, is the word public school in there.  Ms. Riggs said yes.  Alderman Neitzel said thank you.  Alderman Neitzel said I make a motion to waive the second reading and adopt the ordinance as read and Alderman Rohlfs seconded it.  Mayor Davis-Kavelman asked if there was any discussion on this ordinance.  Alderman Neitzel said while we're on the TV tonight I just want to explain to the people of Lincoln that it is the City Council that we are trying to reduce the number of truants in our town to, so that the students may regain their self esteem and be better citizens of Lincoln and reduce the number of public aid recipients that is our intention.  City Clerk Ms. Riggs called the roll.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, one absent (Alderman Prather); motion carried.

Truancy Ordinance tabled on December 3, 2007

 

Mayor Davis-Kavelman said we have a Truancy Ordinance and thanked Alderman Neitzel and City Attorney Mr. Bates and everyone else that helped with this and we have Regional Superintendent of Schools in the background and asked Mrs. Anderson if she wanted to say anything.  Mrs. Anderson said just thank you very much I appreciate it.  Mayor Davis-Kavelman said thanks for working with us. 

 

Proclamation for Carroll Catholic Schools Week 2008

 

Alderman Rohlfs asked City Clerk Ms. Riggs to read the Proclamation for Carroll Catholic Schools Week.  City Clerk Ms. Riggs read the Proclamation.  Alderman Rohlfs made a motion to approve as read and Alderman Huskins seconded it.  Mayor Davis-Kavelman said I did want to say that I go every year and read this to the students and had another commitment and could not get there and didn't get to tell them until afterwards so I do apologize.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, one absent (Alderman Prather); motion carried. 

 

Ordinance Rezoning Real Estate to C-2 located in City of Lincoln, Logan County, Illinois (703 Keokuk Street, 711 N. Kickapoo Street, and 713 N. Kickapoo Street)

 

Alderman Rohlfs asked City Clerk Ms. Riggs to read the Committee's Report.  City Clerk Ms. Riggs read the Committee's Report.  Alderman Rohlfs said I move to accept the Committee's Report and Alderman Neitzel seconded it.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, one absent (Alderman Prather); motion carried.  Alderman Rohlfs said I move to waive the second reading and approve the ordinance rezoning real estate to C-2 located in the City of Lincoln Logan County, Illinois at 703 Keokuk Street, 711 and 713 N. Kickapoo Street and Alderman Neitzel seconded it.  Alderman Huskins said are they planning on putting something here or what they just want a change.  Mayor Davis-Kavelman said I don't know they just asked to change.  Mr. Bates said I had no idea I wasn't at the Planning Commission meeting when it was discussed and it probably wasn't discussed anyway as part of the request and I don't know the answer.  City Clerk Ms. Riggs called the roll.   There were eight yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), one nay (Alderman Huskins), one absent (Alderman Prather); motion carried. 

 

Ordinance Amending Section 9-5-1 of the City Code of the City of Lincoln

 

Alderman Rohlfs asked City Clerk Ms. Riggs to read the Committee's Report.  City Clerk Ms. Riggs read the Committee's Report.

Ordinance Amending Section 9-5-1 of the City Code of the City of Lincoln

 

Alderman Rohlfs said I move to accept the Committee's Report and Alderman Neitzel seconded it.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, one absent (Alderman Prather); motion carried.  Alderman Rohlfs said I move to accept the ordinance amending section 9-5-1 of the City Code of the City of Lincoln which deals with fines for parking violations and provides for parking monitors for the City of Lincoln.  Mr. Bates said that one has not been read.  Mayor Davis-Kavelman said would you like to have that read.  Alderman Rohlfs said would you please read that one.  City Clerk Ms. Riggs read the ordinance.  Alderman Rohlfs said I move to waive the second reading and approve the Ordinance amending section 9-5-1 of the City Code of the City of Lincoln and Alderman Neitzel seconded it.  City Clerk Ms. Riggs called the roll.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, one absent (Alderman Prather); motion carried. 

 

The Mayor then asked for the Presentation of Claims, Presentations, Reading, Reference and Reports Thereon:

 

Alderman Anderson made a motion by Roll Call to approve all claims as presented: Finance, Policy & Procedure, Sanitation, Insurance, and Grounds, Buildings & Local Improvements Committees' Reports by roll call and Alderman Busby seconded it.  City Clerk Ms. Riggs called the roll.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, and one absent (Alderman Prather); motion carried. 

 

Mayor Davis-Kavelman then asked for the Presentation of Official Reports:

City Clerk Ms. Riggs said there were no Official Reports to come before the City Council.

 

Mayor Davis-Kavelman asked for the Presentation of Special Reports:

City Clerk Ms. Riggs said there were no Special Reports to come before the City Council.

 

Mayor Davis-Kavelman asked for the Presentation of Unfinished Business:

City Clerk Ms. Riggs said there was no Unfinished Business to come before the City Council.

 

Mayor Davis-Kavelman asked for New Business:

 

Appointment to the Abraham Lincoln Bicentennial Commission (tabled 12-3-07)

 

Mayor Davis-Kavelman said we're still working on that and we have a meeting on Thursday so I want to keep that on the table please.

Approval of ground lease with United States Cellular Operating Company of Chicago, LLC

 

Alderman Tibbs made a motion to table and Alderman Huskins seconded it.  City Clerk Ms. Riggs called the roll.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, one absent (Alderman Prather); motion carried. 

 

Approval of Deputy Chief for the Police Department

 

Alderman Horn said I move to accept Chief Erlenbush's recommendation to appoint Sergeant Mike Geriets to Deputy Chief and Alderman Neitzel seconded it.  City Clerk Ms. Riggs called the roll.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, one absent (Alderman Prather); motion carried. 

 

Mayor Davis-Kavelman said I just want remind everyone to vote and exercise your right to vote tomorrow.  Alderman Huskins said next Tuesday we will meet instead of Monday.  Mayor Davis-Kavelman said yes oh good we will be meeting on Monday instead of Tuesday because of the holiday. 

 

Alderman Huskins made a motion to adjourn and Alderman Anderson seconded it.  There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, and one absent (Alderman Prather); motion carried. 

 

The City Council Meeting was adjourned at 8:21 p.m.
